The rights and obligations arising from the health insurance are suspended by operation of law during the period in which Our Minister of Justice is responsible for the provision of medical care to an insured person in the context of the execution of a judicial decision.
The first paragraph does not apply during the period in which a person who is not a detainee within the meaning of the Forensic Care Act (Wet forensische zorg) receives forensic care as referred to in that Act.
The rights and obligations arising from the health insurance are likewise suspended by operation of law during the period that an insured person, as evidenced by a statement from the Minister of Foreign Affairs or a statement from Reclassering Nederland, is held in detention outside the Netherlands.
The policyholder, the insured, or the authorized representative of the policyholder or the insured shall notify the health insurer of the day on which the period referred to in the first or third paragraph commences, whereby, if the third paragraph is applicable, he shall also submit the statement referred to therein to the health insurer.
De rechten en plichten uit de zorgverzekering zijn van rechtswege opgeschort gedurende de periode waarover Onze Minister van Justitie in het kader van de uitvoering van een rechterlijke uitspraak verantwoordelijk is voor de verstrekking van geneeskundige zorg aan een verzekerde.
Het eerste lid is niet van toepassing gedurende de periode waarover iemand die geen gedetineerde is in de zin van de Wet forensische zorg, forensische zorg als bedoeld in die wet geniet.
De rechten en plichten uit de zorgverzekering zijn eveneens van rechtswege opgeschort gedurende de periode dat een verzekerde blijkens een verklaring van de Minister van Buitenlandse Zaken of een verklaring van Reclassering Nederland buiten Nederland in detentie is genomen.
De verzekeringnemer, de verzekerde, of de gemachtigde van de verzekeringnemer of verzekerde meldt de zorgverzekeraar de dag waarop de periode, bedoeld in het eerste of derde lid, aanvangt, waarbij hij indien het derde lid van toepassing is, tevens de daar bedoelde verklaring aan de zorgverzekeraar overlegt.
