The amount of the administrative fine shall be determined by Order in Council, on the understanding that the administrative fine for a separate violation shall not exceed € 5,000,000, or, in cases as referred to in the fourth paragraph, shall not exceed € 10,000,000.
The general administrative order referred to in the first paragraph shall determine, for each infringement described therein, the maximum amount of the administrative fine to be imposed. The infringements shall be classified into categories according to the severity of the infringement, with the corresponding base amounts, minimum amounts, and maximum amounts. In doing so, the following classification shall be used:
By way of derogation from the second paragraph, the base amount for the administrative fine for an infringement classified in the third category shall be € 2,500,000 if the fine is imposed on an institution as referred to in Article 1a, second, third, or fourth paragraph, point f, or on a manager as referred to in Article 1a, sixth paragraph, and the maximum amount of the administrative fine shall be € 5,000,000.
If, at the time of committing the violation, a period of five years has not yet elapsed since the imposition of an administrative fine on the violator in respect of an identical violation, the administrative fine for a separate violation shall amount to no more than twice the maximum amount applicable pursuant to the second or third paragraph.
Het bedrag van de bestuurlijke boete wordt bepaald bij algemene maatregel van bestuur, met dien verstande dat de bestuurlijke boete voor een afzonderlijke overtreding ten hoogste € 5.000.000, of, in gevallen als bedoeld in het vierde lid, ten hoogste € 10.000.000 bedraagt.
De algemene maatregel van bestuur, bedoeld in het eerste lid, bepaalt bij elke daarin omschreven overtreding het maximale bedrag van de op te leggen bestuurlijke boete. De overtredingen worden gerangschikt in categorieën naar zwaarte van de overtreding met de daarbij behorende basisbedragen, minimumbedragen en maximumbedragen. Daarbij wordt de volgende indeling gebruikt:
In afwijking van het tweede lid, bedraagt het basisbedrag voor de bestuurlijke boete voor een overtreding die is gerangschikt in de derde categorie indien de boete wordt opgelegd aan een instelling als bedoeld in artikel 1a, tweede, derde, of vierde lid, onderdeel f, of aan een beheerder als bedoeld in artikel 1a, zesde lid, € 2.500.000,– en is het maximumbedrag van de bestuurlijke boete € 5.000.000,–.
Indien ten tijde van het plegen van de overtreding nog geen vijf jaren zijn verstreken sinds het opleggen van een bestuurlijke boete aan de overtreder ter zake van eenzelfde overtreding, bedraagt de bestuurlijke boete voor een afzonderlijke overtreding ten hoogste tweemaal het ingevolge het tweede of derde lid toepasselijke maximumbedrag.
