Subject to the provisions of the following paragraph, Our Minister shall, as soon as possible after receipt of an advice as referred to in the preceding article, decide on the action to be taken in respect thereof. In doing so, if the petition for enforcement or for the transfer of supervision can be based on a treaty, he shall observe the provisions of that treaty.
If the advice of the Public Prosecution Service concerns a convicted person who is in the Netherlands, upon whom a sanction involving deprivation of liberty has been imposed and who has not declared that they consent to the transfer of the enforcement of that sanction, then Our Minister, if they intend to act upon this advice, shall, before taking a decision, notify the convicted person of this advice in writing. In doing so, the convicted person shall be informed that they may, within fourteen days of receipt of the notification, submit a notice of objection against the intention of Our Minister to the court that imposed the sanction involving deprivation of liberty in the highest instance of fact.
As soon as possible after receipt of a timely filed notice of objection, the court referred to in the previous paragraph shall examine whether Our Minister, upon weighing the interests involved, can reasonably arrive at the intended decision. The convicted person shall be heard during the examination, or at least summoned. If it does not appear that the convicted person already has legal counsel, the presiding judge shall instruct the board of the Legal Aid Council to appoint legal counsel.
Articles 21 to 26 inclusive and Article 29c of the Code of Criminal Procedure shall apply mutatis mutandis.
The court shall notify Our Minister and the convicted person of its decision in writing. If the court considers the objection well-founded, Our Minister shall not give effect to the advice of the Public Prosecution Service to transfer the enforcement.
Behoudens het bepaalde in het volgende lid beslist Onze Minister zo spoedig mogelijk na de ontvangst van een advies als bedoeld in het vorige artikel omtrent het daaraan te geven gevolg. Daarbij neemt hij, indien het verzoek tot tenuitvoerlegging of tot overname van toezicht op een verdrag kan worden gegrond, de bepalingen van dat verdrag in acht.
Indien het advies van het openbaar ministerie betrekking heeft op een veroordeelde die zich in Nederland bevindt, aan wie een tot vrijheidsbeneming strekkende sanctie is opgelegd en die niet heeft verklaard met de overdracht van de tenuitvoerlegging van die sanctie in te stemmen, dan laat Onze Minister, zo hij voornemens is gevolg te geven aan dit advies, alvorens een beslissing te nemen de veroordeelde schriftelijk van dit advies in kennis stellen. Daarbij wordt de veroordeelde medegedeeld, dat hij binnen veertien dagen na ontvangst van de kennisgeving tegen het voornemen van Onze Minister een bezwaarschrift kan indienen bij het gerecht, dat in hoogste feitelijke instantie de tot vrijheidsbeneming strekkende sanctie heeft opgelegd.
Zo spoedig mogelijk na ontvangst van een tijdig ingediend bezwaarschrift onderzoekt het in het vorige lid bedoelde gerecht of Onze Minister bij afweging van de betrokken belangen in redelijkheid tot de voorgenomen beslissing kan komen. De veroordeelde wordt bij het onderzoek gehoord, althans opgeroepen. Indien niet blijkt dat de veroordeelde reeds een raadsman heeft, geeft de voorzitter aan het bestuur van de raad voor rechtsbijstand last tot aanwijzing van een raadsman.
De artikelen 21–26 en 29c van het Wetboek van Strafvordering zijn van overeenkomstige toepassing.
Van zijn beslissing stelt het gerecht Onze Minister en de veroordeelde schriftelijk in kennis. Acht het gerecht het bezwaarschrift gegrond, dan geeft Onze Minister aan het advies van het openbaar ministerie tot overdracht van de tenuitvoerlegging geen gevolg.
