Leave for the enforcement of a sanction imposed in a foreign state aimed at the deprivation of unlawfully obtained advantage may be limited to the enforcement of the obligation to pay a sum of money to the state, which in amount represents only a portion of that advantage.
If the sanction imposed in the foreign state aims at the deprivation of illegally obtained advantage, the court shall, if the foreign state has expressly requested that such sanction be enforced only against objects representing that advantage, pronounce the forfeiture thereof.
The provisions of Articles 552b, 552d, 552e and 552g of the Code of Criminal Procedure shall apply mutatis mutandis to judicial decisions containing an order for forfeiture.
The provisions of Articles 6:4:9 and 6:6:26 of the Code of Criminal Procedure shall apply mutatis mutandis to judicial decisions imposing an obligation to pay a sum of money to the State for the purpose of deprivation of illegally obtained benefits.
Article 13e shall apply mutatis mutandis.
Verlof tot tenuitvoerlegging van een in de vreemde staat opgelegde sanctie strekkende tot ontneming van wederrechtelijk verkregen voordeel kan worden beperkt tot de tenuitvoerlegging van de verplichting tot betaling van een geldbedrag aan de staat, dat in omvang slechts een gedeelte van dat voordeel vertegenwoordigt.
Indien de in de vreemde staat opgelegde sanctie strekt tot de ontneming van wederrechtelijk verkregen voordeel, spreekt de rechtbank, indien de vreemde staat uitdrukkelijk heeft verzocht die sanctie slechts ten uitvoer te leggen op voorwerpen die dat voordeel vertegenwoordigen, de verbeurdverklaring daarvan uit.
Op uitspraken, houdende een verbeurdverklaring, is het bepaalde in de artikelen 552b, 552d, 552e en 552g van het Wetboek van Strafvordering van overeenkomstige toepassing.
Op uitspraken, houdende de oplegging van een verplichting tot betaling van een geldbedrag aan de staat ter ontneming van wederrechtelijk verkregen voordeel, is het bepaalde in de artikelen 6:4:9 en 6:6:26 van het Wetboek van Strafvordering van overeenkomstige toepassing.
Artikel 13e is van overeenkomstige toepassing.
