The exercise of the office of civil-law notary

1.

The civil-law notary is prohibited, directly or indirectly, from performing or omitting acts of which he must reasonably expect that they may lead to him being unable to fulfill his financial obligations at any time.

2.

In any event, the civil-law notary (notaris) is prohibited from:

a.

to enter into loans, except insofar as these are reasonably necessary for the performance of the office or for personal purposes;

b.

to provide loans to a person who is a party to a deed or who is directly or indirectly involved in a legal act to which the deed relates;

c.

to stand surety or otherwise guarantee the debts of others, except insofar as this is reasonably necessary for the performance of the office or for personal purposes.

3.

The legal validity of a juridical act performed in violation of the first and second paragraphs shall not be challengeable on that ground.

Het is de notaris verboden, rechtstreeks of middellijk, handelingen te verrichten of na te laten waarvan hij redelijkerwijs moet verwachten dat zij ertoe kunnen leiden, dat hij te eniger tijd niet zal kunnen voldoen aan zijn financiële verplichtingen.

2.

In ieder geval is het de notaris verboden:

a.

leningen aan te gaan, behoudens voor zover deze redelijkerwijs nodig zijn voor de uitoefening van het ambt of voor persoonlijke doeleinden;

b.

leningen te verstrekken aan degene die partij is bij een akte of die rechtstreeks of middellijk betrokken is bij een rechtshandeling waarop de akte betrekking heeft;

c.

zich borg te stellen of anderszins in te staan voor schulden van anderen, behoudens voor zover dit redelijkerwijs nodig is voor de uitoefening van het ambt of voor persoonlijke doeleinden.

3.

De rechtsgeldigheid van een rechtshandeling welke is verricht in strijd met het eerste en tweede lid is niet uit dien hoofde aantastbaar.
