The Public Prosecution Service shall decide on the recognition of the judicial decision within a period of sixty days after receipt of the certificate.
The decision of the Public Prosecution Service may only be postponed:
until a translation is available as referred to in Article 3:8, paragraph 3;
until the petition referred to in Article 3:8, paragraph 4, has been complied with within a reasonable term;
if, due to exceptional circumstances, it is not possible to meet the time limit referred to in the first paragraph.
The Public Prosecution Service shall notify the competent authority of the issuing Member State without delay of the exceptional circumstances referred to in paragraph 2, point (c), and of the time required to reach a decision.
Het openbaar ministerie beslist binnen een termijn van zestig dagen na ontvangst van het certificaat over de erkenning van de rechterlijke uitspraak.
De beslissing van het openbaar ministerie kan slechts worden uitgesteld:
totdat een vertaling beschikbaar is als bedoeld in artikel 3:8, derde lid;
totdat binnen redelijke termijn is voldaan aan het verzoek, bedoeld in artikel 3:8, vierde lid;
indien het vanwege uitzonderlijke omstandigheden niet mogelijk is de termijn, bedoeld in het eerste lid, te halen.
Het openbaar ministerie stelt de bevoegde autoriteit van de uitvaardigende lidstaat onverwijld in kennis van de uitzonderlijke omstandigheden, bedoeld in het tweede lid, onder c, en van de tijd die benodigd is om een beslissing te nemen.
