The institution of proceedings by way of summons may take place for all criminal offences for which this is not expressly excluded. Such exclusion shall be effected, after hearing the Public Prosecution Service, by Order in Council.
The Public Prosecution Service at the court may issue the necessary general or specific instructions to investigative officers regarding whether or not to initiate proceedings by summons in cases brought before the sub-district court (kantonrechter).
Het aanhangig maken door oproeping kan geschieden bij alle strafbare feiten waarbij dit niet uitdrukkelijk is uitgesloten. De uitsluiting geschiedt, gehoord het openbaar ministerie, bij algemene maatregel van bestuur.
Het openbaar ministerie bij de rechtbank kan ten aanzien van het al of niet aanhangig maken door oproeping, van zaken die voor de kantonrechter worden gebracht aan de opsporingsambtenaren de nodige algemene of bijzondere voorschriften geven.
