If the examining magistrate, on the basis of the investigation referred to in the preceding article, finds grounds to do so, he shall order the immediate release of the suspect.
In the other case, the examining magistrate shall order, if the suspect has been guilty of violating the orders given to him, that he shall be placed in police custody. Articles 545, paragraphs two, four and five, and 546, with the exception of the second sentence of the second paragraph, shall apply.
In any event, the examining magistrate may, if it appears to him that the suspect has not complied with the orders given to him, in the order referred to in the first or second paragraph, also declare the security forfeited to the State.
Article 83 shall apply mutatis mutandis.
Indien de rechter-commissaris op grond van het onderzoek bedoeld in het voorgaande artikel, daartoe termen vindt, beveelt hij de onmiddellijke invrijheidstelling van den verdachte.
In het andere geval beveelt de rechter-commissaris, indien de verdachte zich aan overtreding der hem gegeven bevelen heeft schuldig gemaakt, dat deze in verzekering zal worden gesteld. De artikelen 545, tweede, vierde en vijfde lid, en 546, met uitzondering van den tweeden zin van het tweede lid, zijn van toepassing.
In elk geval kan de rechter-commissaris, indien hem blijkt dat de verdachte de hem gegeven bevelen niet is nagekomen, bij het bevel, bedoeld in het eerste of tweede lid, tevens de zekerheid vervallen verklaren aan den Staat.
Artikel 83 is van overeenkomstige toepassing.
