The court may, upon the claim of the public prosecutor, order the continued detention (gevangenhouding) of the suspect who is in custody (bewaring). The suspect shall be heard prior to the order, unless he has declared in writing that he waives the right to be heard. The court or the presiding judge may, notwithstanding such a declaration, order the production of the suspect.
Without prejudice to the case referred to in Article 66a, paragraph 1, the court may, of its own motion or upon the claim of the public prosecutor, order the detention of the suspect after the commencement of the examination at the hearing. If desired, the court shall hear the suspect beforehand; for this purpose, it is authorised to order his summons, if necessary accompanied by an order for his apprehension.
The court may also issue an order for arrest, if this is necessary to obtain the extradition of the suspect.
De rechtbank kan, op de vordering van de officier van justitie, de gevangenhouding bevelen van de verdachte die zich in bewaring bevindt. De verdachte wordt voorafgaand aan het bevel gehoord, tenzij hij schriftelijk heeft verklaard afstand te doen van het recht te worden gehoord. De rechtbank of de voorzitter kan, niettegenstaande een dergelijke verklaring, de medebrenging van de verdachte bevelen.
Behoudens het geval van artikel 66a, eerste lid, kan de rechtbank, ambtshalve of op de vordering van de officier van justitie, na de aanvang van het onderzoek ter zitting de gevangenneming van de verdachte bevelen. Desgeraden hoort de rechtbank deze vooraf; zij is bevoegd te dien einde zijn dagvaarding te gelasten, zo nodig onder bijvoeging van een bevel tot medebrenging.
De rechtbank kan eveneens een bevel tot gevangenneming geven, indien dit nodig is om de uitlevering van de verdachte te verkrijgen.
