The drawer, as well as the holder of a cheque, may prohibit it from being paid in cash by stating diagonally on the face: "to be credited to account", or by including a similar expression.

In that case, the cheque may only give rise to a book entry by the drawee (current account, giro or set-off). The book entry constitutes payment.

3.

The striking out of the indication: "to be brought into account" is deemed not to have taken place.

4.

The person concerned, who fails to comply with the above provisions, is liable for the damage up to the amount of the cheque.

De trekker, alsmede de houder van eene chèque, kan verbieden, dat deze in baar geld betaald wordt door op de voorzijde in schuinsche richting te vermelden: "in rekening te brengen", of een soortgelijke uitdrukking op te nemen.

In dat geval mag de chèque den betrokkene slechts aanleiding geven tot eene boeking (rekening-courant, giro of schuldvergelijking). De boeking geldt als betaling.

3.

De doorhaling van de vermelding: "in rekening te brengen" wordt geacht niet te zijn geschied.

4.

De betrokkene, die de bovenstaande bepalingen niet naleeft, is verantwoordelijk voor de schade tot beloop van het bedrag van de chèque.
