1.

The cheque may be made payable:

to a named person, with or without the express clause: "to order";

to a named person, with the clause: "not to order", or a similar clause;

To bearer

The cheque, made payable to a specified person, with the indication: "or to bearer", or a similar expression, is deemed to be a cheque to bearer.

3.

A cheque without mention of the payee is deemed to be a cheque payable to bearer.

De chèque kan betaalbaar worden gesteld:

aan een met name genoemden persoon, met of zonder uitdrukkelijke clausule: "aan order";

aan een met name genoemden persoon, met de clausule: "niet aan order", of een soortgelijke clausule;

aan toonder.

2.

De chèque, betaalbaar gesteld aan een met name genoemden persoon, met de vermelding: "of aan toonder", of een soortgelijke uitdrukking, geldt als chèque aan toonder.

3.

De chèque zonder vermelding van den nemer geldt als chèque aan toonder.
