The cheque must be drawn on a banker who holds funds at the disposal of the drawer, and pursuant to an express or implied agreement under which the drawer has the right to dispose of those funds by cheque. In the event of non-compliance with these provisions, the instrument nevertheless remains valid as a cheque.
De chèque moet worden getrokken op eenen bankier, die fonds onder zich heeft ter beschikking van den trekker, en krachtens een uitdrukkelijke of stilzwijgende overeenkomst, volgens welke de trekker het recht heeft per chèque over dat fonds te beschikken. In geval van niet-inachtneming van die voorschriften blijft de titel echter als chèque geldig.
