The board of the Court of Appeal of The Hague shall constitute a multi-judge chamber, designated as the chamber for plant breeders' rights, for the purpose of hearing and deciding cases as referred to in Article 78, paragraph 3, of the Seeds and Planting Material Act 2005. The board shall determine the composition of this chamber.
The Chamber for Plant Breeders' Rights consists of three judicial officers charged with the administration of justice and two persons, not being judicial officers, as expert members. Articles 7, paragraph 3, 12, and 13 up to and including 13g shall apply mutatis mutandis to the expert members. Furthermore, Articles 44, paragraphs 1, 4 up to and including 8, and 10, and 44a, paragraphs 1 up to and including 8, and 10, of the Legal Status of Judicial Officers Act (Wet rechtspositie rechterlijke ambtenaren) shall apply mutatis mutandis to these members, on the understanding that the board of the court shall be regarded as their functional authority, that for the purposes of the mutatis mutandis application of Article 44, paragraphs 1 and 7, they shall be equated with deputy judges in the same court, and that the president of the court shall exercise the authority referred to in Article 44, paragraph 6, with respect to them.
Het bestuur van het gerechtshof Den Haag vormt voor het behandelen en beslissen van zaken als bedoeld in artikel 78, derde lid, van de Zaaizaad- en plantgoedwet 2005, een meervoudige kamer onder de benaming van kamer voor het kwekersrecht. Het bestuur bepaalt de bezetting van deze kamer.
De kamer voor het kwekersrecht bestaat uit drie rechterlijke ambtenaren met rechtspraak belast en twee personen, niet zijnde rechterlijk ambtenaar, als deskundige leden. Op de deskundige leden zijn de artikelen 7, derde lid, 12 en 13 tot en met 13g van overeenkomstige toepassing. Tevens zijn de artikelen 44, eerste, vierde tot en met achtste en tiende lid, en 44a, eerste tot en met achtste en tiende lid, van de Wet rechtspositie rechterlijke ambtenaren op deze leden van overeenkomstige toepassing, met dien verstande dat het bestuur van het gerecht wordt aangemerkt als hun functionele autoriteit, zij voor de overeenkomstige toepassing van artikel 44, eerste en zevende lid, worden gelijkgesteld met plaatsvervangers in hetzelfde gerecht, en de president van het gerecht ten aanzien van hen de bevoegdheid, bedoeld in artikel 44, zesde lid, uitoefent.
