The board of the District Court of The Hague shall constitute single-judge and multi-judge chambers for the hearing and adjudication of cases pursuant to the Defence Civil Servants Act (Wet ambtenaren defensie) and shall determine the composition thereof.
The person presiding over a single-judge chamber as referred to in the first paragraph shall bear the title of military administrative judge.
A multi-judge chamber consists of two judicial officers charged with the administration of justice and one military member, who is preferably from the branch of the armed forces to which the person who has lodged the appeal belongs or belonged. Articles 7, paragraph 3, 12, and 13 up to and including 13g apply mutatis mutandis to the military member. Furthermore, Articles 44, paragraphs 1, 4 up to and including 8, and 10, and 44a, paragraphs 1 up to and including 8, and 10, of the Legal Status of Judicial Officers Act (Wet rechtspositie rechterlijke ambtenaren) apply mutatis mutandis to this member, on the understanding that the board of the court is regarded as his functional authority, this member is equated with deputy judges in the same court for the mutatis mutandis application of Article 44, paragraphs 1 and 7, and the president of the court exercises the authority referred to in Article 44, paragraph 6, with respect to this member.
Het bestuur van de rechtbank Den Haag vormt voor het behandelen en beslissen van zaken op grond van de Wet ambtenaren defensie enkelvoudige en meervoudige kamers en bepaalt de bezetting daarvan.
Degene die zitting heeft in een enkelvoudige kamer als bedoeld in het eerste lid draagt de titel van militaire ambtenarenrechter.
Een meervoudige kamer bestaat uit twee rechterlijke ambtenaren met rechtspraak belast en een militair lid, dat bij voorkeur afkomstig is uit het krijgsmachtdeel waartoe degene die beroep heeft ingesteld behoort of behoorde. Op het militaire lid zijn de artikelen 7, derde lid, 12 en 13 tot en met 13g van overeenkomstige toepassing. Tevens zijn de artikelen 44, eerste, vierde tot en met achtste en tiende lid, en 44a, eerste tot en met achtste en tiende lid, van de Wet rechtspositie rechterlijke ambtenaren op dit lid van overeenkomstige toepassing, met dien verstande dat het bestuur van het gerecht wordt aangemerkt als zijn functionele autoriteit, dit lid voor de overeenkomstige toepassing van artikel 44, eerste en zevende lid, wordt gelijkgesteld met plaatsvervangers in hetzelfde gerecht, en de president van het gerecht ten aanzien van dit lid de bevoegdheid, bedoeld in artikel 44, zesde lid, uitoefent.
