At a court, the following persons are employed:
judicial officers charged with the administration of justice, and
court officials
Judges in training, senior judicial assistants, and judicial assistants may be employed at a court.
The court officials, trainee judges, senior legal clerks, and legal clerks designated for this purpose by the board of a court shall perform the duties assigned to the registrar by or pursuant to the law. They are also authorised to perform these duties for other courts. The designation shall be made in writing.
The board of a court may designate persons, other than a judicial officer charged with the administration of justice, a court official, a judge in training, a senior judicial auditor, or a judicial auditor, as deputy registrar. In that capacity, they may be summoned by the board to perform duties that are assigned to the registrar by or pursuant to the law. The third paragraph, second sentence, applies mutatis mutandis. Before being summoned for the first time, they shall take the oath or make the affirmation. The form for the oath or affirmation shall be established and rules regarding the swearing-in shall be set by or pursuant to an Order in Council. A remuneration shall be granted to the deputy registrars by the court board in accordance with rules to be set by or pursuant to an Order in Council.
A deputy registrar shall be dismissed by the board of the court upon their own petition.
The board of the court may dismiss a deputy registrar:
if he has not performed any registrar duties for a period of at least three years;
on the grounds of unsuitability other than by reason of illness; or
by reason of the commission or omission of that which a person, working on behalf of a court, ought to omit or perform.
If a court official, trainee judge, senior judicial research officer, judicial research officer or assistant clerk performs clerical duties in support of a judicial officer charged with the administration of justice or an expert member, he is obliged to comply with the instructions of that judicial officer or that expert member.
Bij een gerecht zijn werkzaam:
rechterlijke ambtenaren met rechtspraak belast, en
gerechtsambtenaren.
Bij een gerecht kunnen rechters in opleiding, senior-gerechtsauditeurs en gerechtsauditeurs werkzaam zijn.
De daartoe door het bestuur van een gerecht aangewezen gerechtsambtenaren, rechters in opleiding, senior-gerechtsauditeurs en gerechtsauditeurs verrichten de werkzaamheden die bij of krachtens de wet aan de griffier zijn opgedragen. Zij zijn bevoegd deze werkzaamheden ook voor andere gerechten uit te voeren. De aanwijzing geschiedt schriftelijk.
Het bestuur van een gerecht kan personen, niet zijnde rechterlijk ambtenaar met rechtspraak belast, gerechtsambtenaar, rechter in opleiding, senior-gerechtsauditeur of gerechtsauditeur, aanwijzen als buitengriffier. Zij kunnen in die hoedanigheid door het bestuur worden opgeroepen voor het verrichten van werkzaamheden die bij of krachtens de wet aan de griffier zijn opgedragen. Het derde lid, tweede volzin, is van overeenkomstige toepassing. Alvorens voor de eerste keer te worden opgeroepen leggen zij de eed of belofte af. Bij of krachtens algemene maatregel van bestuur wordt het formulier voor de eed of belofte vastgesteld en worden regels gesteld over de beëdiging. Aan de buitengriffiers wordt volgens bij of krachtens algemene maatregel van bestuur te stellen regels door het gerechtsbestuur een vergoeding toegekend.
Een buitengriffier wordt op eigen verzoek door het bestuur van het gerecht ontslagen.
Het bestuur van het gerecht kan een buitengriffier ontslaan:
indien hij gedurende een periode van ten minste drie jaar geen griffierswerkzaamheden heeft verricht;
op grond van ongeschiktheid anders dan wegens ziekte; of
wegens het doen of nalaten van hetgeen een persoon, werkzaam ten behoeve van een gerecht, behoort na te laten of te doen.
Indien een gerechtsambtenaar, rechter in opleiding, senior-gerechtsauditeur, gerechtsauditeur of buitengriffier griffierswerkzaamheden verricht ter ondersteuning van een rechterlijk ambtenaar met rechtspraak belast of een deskundig lid, is hij verplicht te voldoen aan de aanwijzingen van die rechterlijk ambtenaar of dat deskundig lid.
