The entrepreneur upon whom the obligation to establish a works council rests shall, by means of a provisional regulation, make such provisions as fall within the competence of the works council, insofar as necessary, until the works council itself exercises such competence. The association or associations of employees referred to in Article 9, paragraph 2, under a, shall be heard regarding the provisional regulation.
Article 8, paragraph 1, first and second sentences, and paragraph 2, shall apply mutatis mutandis to the provisional regulations. The provisional regulations shall lapse at the time at which the works council has established the regulations referred to in Article 8.
The preceding paragraphs shall apply mutatis mutandis to the entrepreneur or the entrepreneurs who have established a central works council or a group works council.
De ondernemer op wie de verplichting tot het instellen van een ondernemingsraad rust, treft bij voorlopig reglement, voor zover nodig, de voorzieningen die tot de bevoegdheid van de ondernemingsraad behoren, totdat de ondernemingsraad zelf die bevoegdheid uitoefent. De vereniging of verenigingen van werknemers, bedoeld in artikel 9, tweede lid, onder a, worden over het voorlopige reglement gehoord.
Ten aanzien van het voorlopige reglement is artikel 8, eerste lid, eerste en tweede volzin en tweede lid, van overeenkomstige toepassing. Het voorlopige reglement vervalt op het tijdstip waarop de ondernemingsraad het in artikel 8 bedoelde reglement heeft vastgesteld.
De voorgaande leden zijn van overeenkomstige toepassing ten aanzien van de ondernemer of de ondernemers die een centrale ondernemingsraad of een groepsondernemingsraad hebben ingesteld.
