The entrepreneur is obliged to provide the members of the works council and the members of the committees of that council, during a number of hours per year to be jointly determined by the entrepreneur and the works council, the opportunity during working hours and with retention of wages or remuneration for mutual deliberation and consultation with other persons regarding matters in which they are involved in the performance of their duties, as well as for becoming acquainted with the working conditions within the enterprise.
The entrepreneur is obliged to offer the members of the works council and the members of a standing committee or sub-committee, as referred to in Article 15, paragraph 2, or paragraph 3, respectively, for a number of days per year to be jointly determined by the entrepreneur and the works council, the opportunity to receive training and education of sufficient quality which they deem necessary in connection with the performance of their duties, during working hours and with retention of wages or remuneration.
The entrepreneur and the works council shall determine the number of hours, as referred to in the first paragraph, and the number of days, as referred to in the second paragraph, at such a number as the involved members of the works council and of the committees of that council reasonably require for the performance of their duties. In doing so, it shall be observed that the number of hours may not be set lower than sixty per year and the number of days:
for members of a committee as referred to in the second paragraph who are not also members of the works council, may not be set at less than three per year;
for members of the works council who are not also members of a committee as referred to in the second paragraph, may not be set lower than five per year; and
for members of the works council who are also members of a committee, may not be set lower than eight per year.
The works council, as well as any member of the works council or of a committee of that council, may petition the sub-district court to order the entrepreneur to comply with the provisions set forth in the first, second, and third paragraphs.
De ondernemer is verplicht de leden van de ondernemingsraad en de leden van de commissies van die raad, gedurende een door de ondernemer en de ondernemingsraad gezamenlijk vast te stellen aantal uren per jaar, in werktijd en met behoud van loon dan wel bezoldiging de gelegenheid te bieden voor onderling beraad en overleg met andere personen over aangelegenheden waarbij zij in de uitoefening van hun taak zijn betrokken, alsmede voor kennisneming van de arbeidsomstandigheden in de onderneming.
De ondernemer is verplicht de leden van de ondernemingsraad en de leden van een vaste commissie of onderdeelcommissie, bedoeld in artikel 15, tweede lid, onderscheidenlijk derde lid, gedurende een door de ondernemer en de ondernemingsraad gezamenlijk vast te stellen aantal dagen per jaar, in werktijd en met behoud van loon dan wel bezoldiging de gelegenheid te bieden de scholing en vorming van voldoende kwaliteit te ontvangen welke zij in verband met de vervulling van hun taak nodig oordelen.
De ondernemer en de ondernemingsraad stellen het aantal uren, bedoeld in het eerste lid, en het aantal dagen, bedoeld in het tweede lid, vast op een zodanig aantal als de betrokken leden van de ondernemingsraad en van de commissies van die raad voor de vervulling van hun taak redelijkerwijze nodig hebben. Daarbij wordt in acht genomen dat het aantal uren niet lager vastgesteld kan worden dan zestig per jaar en het aantal dagen:
voor leden van een in het tweede lid bedoelde commissie die niet tevens lid zijn van de ondernemingsraad, niet lager vastgesteld kan worden dan drie per jaar;
voor leden van de ondernemingsraad die niet tevens lid zijn van een in het tweede lid bedoelde commissie, niet lager vastgesteld kan worden dan vijf per jaar; en
voor leden van de ondernemingsraad die tevens lid zijn van een commissie, niet lager vastgesteld kan worden dan acht per jaar.
De ondernemingsraad, alsmede ieder lid van de ondernemingsraad of van een commissie van die raad kan de kantonrechter verzoeken te bepalen dat de ondernemer gevolg dient te geven aan hetgeen is bepaald in het eerste, het tweede en het derde lid.
