The special negotiating body may be assisted in the negotiations by one or more experts of its choice, including representatives of competent and recognised trade union organisations at Community level as referred to in Article 154 of the Treaty on the Functioning of the European Union. At the request of the special negotiating body, these experts may be present at the meetings referred to in Article 11, paragraph 1, in an advisory capacity.
The costs that are reasonably necessary for the performance of the task of the special negotiating body shall be borne by the Community-scale undertaking or the controlling undertaking. In respect of the costs for consulting one or more experts or for conducting legal proceedings, this shall only apply if the Community-scale undertaking or the controlling undertaking has been notified in advance of the costs to be incurred.
De bijzondere onderhandelingsgroep kan zich in de onderhandelingen doen bijstaan door een of meer deskundigen van haar keuze, waaronder vertegenwoordigers van bevoegde en erkende werknemersorganisaties op communautair niveau als bedoeld in artikel 154 van het Verdrag betreffende de werking van de Europese Unie. Deze deskundigen kunnen op verzoek van de bijzondere onderhandelingsgroep als adviseur aanwezig zijn in de vergaderingen, bedoeld in artikel 11, eerste lid.
De kosten die redelijkerwijze noodzakelijk zijn voor de vervulling van de taak van de bijzondere onderhandelingsgroep komen ten laste van de communautaire onderneming of de moederonderneming. Voor de kosten van het raadplegen van een of meer deskundigen of van het voeren van rechtsgedingen geldt dit slechts, indien de communautaire onderneming of de moederonderneming vooraf van de te maken kosten in kennis is gesteld.
