If it has been established that the conduct took place with or by means of a motor vehicle with which a trailer for which a registration number is required is being propelled, or to which a trailer for which a registration number is required is coupled, and it has not been immediately established who the driver thereof is, the administrative sanction shall, without prejudice to the provisions of Article 31, paragraph 2, be imposed on the person in whose name the registration number of the motor vehicle was entered in the registration register at the time of the conduct. If the registration number of the motor vehicle has not been established, the administrative sanction shall, without prejudice to the provisions of Article 31, paragraph 2, be imposed on the person in whose name the registration number of the trailer was entered in the registration register at the time of the conduct. In both cases, he shall be pointed to the provisions of Article 8.
Indien is vastgesteld dat de gedraging heeft plaatsgevonden met of door middel van een motorrijtuig, waarmee een aanhangwagen waarvoor een kenteken is vereist, wordt voortbewogen, dan wel waaraan een aanhangwagen waarvoor een kenteken is vereist, is gekoppeld, en niet aanstonds is vastgesteld wie daarvan de bestuurder is, wordt, onverminderd het bepaalde in artikel 31, tweede lid, de administratieve sanctie opgelegd aan degene op wiens naam het kenteken van het motorrijtuig ten tijde van de gedraging in het kentekenregister was ingeschreven. Indien het kenteken van het motorrijtuig niet is vastgesteld, wordt, onverminderd het bepaalde in artikel 31, tweede lid, de administratieve sanctie opgelegd aan degene op wiens naam het kenteken van de aanhangwagen ten tijde van de gedraging in het kentekenregister was ingeschreven. In beide gevallen wordt hij gewezen op het bepaalde in artikel 8.
