The service provider shall, upon request, provide Our Minister and the officials designated by Our Minister, as referred to in Article 5, with all data and information necessary for the implementation of this Act.
The first paragraph shall apply mutatis mutandis to self-employed persons to whom the obligation referred to in Article 8, paragraph 6, applies.
If this is necessary in the context of enforcement, the officials designated by Our Minister, as referred to in Article 5, shall assess this on the basis of the elements established by Order in Council:
or whether an undertaking as referred to in Article 1, paragraph 1, of the Posting of Workers Directive, actually performs substantial activities in order to make employees available in the context of the transnational provision of services;
whether a posted worker is performing work in the Netherlands on a temporary basis.
De dienstverrichter verstrekt desgevraagd aan Onze Minister en de door Onze Minister aangewezen ambtenaren, bedoeld in artikel 5, alle gegevens en inlichtingen, die noodzakelijk zijn voor de uitvoering van deze wet.
Het eerste lid is van overeenkomstige toepassing op zelfstandigen voor wie de verplichting geldt, bedoeld in artikel 8, zesde lid.
Indien dit in het kader van de handhaving noodzakelijk is, beoordelen de door Onze Minister aangewezen ambtenaren, bedoeld in artikel 5, aan de hand van de bij algemene maatregel van bestuur vastgestelde elementen:
of een onderneming als bedoeld in artikel 1, eerste lid, van de detacheringsrichtlijn, daadwerkelijk substantiële activiteiten verricht om werknemers ter beschikking te stellen in het kader van transnationale dienstverrichting;
of een gedetacheerde werknemer tijdelijk arbeid in Nederland verricht.
