At the request of the foreign national, a legal counsel shall be assigned to him as soon as he has been deprived of his liberty pursuant to this Act. Article 99, paragraph 3, shall apply mutatis mutandis.
The relief judge (voorzieningenrechter) of the court within whose jurisdiction the foreign national is located shall be competent to issue an order for the assignment of legal aid to the board of the legal aid council. In the event that an appeal has been lodged on the basis of Article 95, the President of the Administrative Jurisdiction Division of the Council of State shall be competent to issue the order for the assignment of legal aid to the board of the legal aid council.
Insofar as the law does not provide for the assignment of counsel in another manner, the board of the legal aid board (raad voor rechtsbijstand) may, at the request of the foreign national, assign a counsel to him.
A petition submitted in accordance with the preceding paragraph shall be granted in cases where it is plausible that the foreign national is unable to bear the costs of a chosen legal counsel and where, in the opinion of that office, there are otherwise sufficient grounds for the assignment of counsel.
Op verzoek van de vreemdeling wordt hem een raadsman toegevoegd zodra hem ingevolge deze wet zijn vrijheid is ontnomen. Artikel 99, derde lid, is van overeenkomstige toepassing.
Bevoegd tot het geven van een last tot toevoeging aan het bestuur van de raad voor rechtsbijstand is de voorzieningenrechter van de rechtbank in het rechtsgebied waarvan de vreemdeling zich bevindt. Ingeval hoger beroep is ingesteld op grond van artikel 95, is de voorzitter van de Afdeling bestuursrechtspraak van de Raad van State bevoegd tot het geven van de last tot toevoeging aan het bestuur van de raad voor rechtsbijstand.
Voorzover de wet niet op andere wijze in de toevoeging voorziet, kan het bestuur van de raad voor rechtsbijstand aan de vreemdeling op diens verzoek een raadsman toevoegen.
Een overeenkomstig het voorgaande lid gedaan verzoek wordt ingewilligd in gevallen waarin aannemelijk is dat de vreemdeling niet in staat is de kosten van een gekozen raadsman te dragen en waarin ook overigens, naar het oordeel van dat bureau, voldoende grond voor toevoeging bestaat.
