1.

Our Minister withdraws the asylum residence permit, referred to in Article 29, in accordance with Articles 65 and 66 of the Procedure Regulation pursuant to Article 14 of the Qualification Regulation.

2.

Our Minister shall withdraw the asylum residence permit, as referred to in Article 29a, in accordance with Articles 65 and 66 of the Procedures Regulation on the basis of Article 19 of the Qualification Regulation.

3.

In the application of the first, second, or sixth paragraph, Our Minister shall simultaneously withdraw the asylum residence permit, as referred to in Articles 29b, 29c, or 29d, which has been granted to the family member of the foreign national whose asylum residence permit has been withdrawn with the application of the first or second paragraph or in respect of whom the sixth paragraph has been applied.

4.

Our Minister may furthermore withdraw the asylum residence permit, as referred to in Article 29b, in the cases referred to in Article 23, paragraphs 3 through 5, of the Qualification Regulation.

5.

Our Minister may furthermore withdraw the residence permit for asylum, as referred to in Articles 29c and 29d, if:

a.

the foreign national has provided incorrect data or has withheld data, whereas such data would have led to the rejection of the original application for the granting;

b.

the foreign national constitutes a danger to public order or national security;

c.

the grounds for granting, as referred to in Articles 29c or 29d, have ceased to exist;

d.

the family member does not or no longer maintains a genuine marriage or family life with the foreign national who enjoys international protection and who is the holder of the residence permit for asylum, as referred to in Articles 29 or 29a.

6.

Upon the closure referred to in Article 66, paragraph 6, of the Procedural Regulation, Our Minister shall record this in the file of the foreign national and shall therein state the legal basis for said closure.

7.

Rules regarding this Article may be established by or pursuant to an order in council (algemene maatregel van bestuur).

Onze Minister trekt de verblijfsvergunning asiel, bedoeld in artikel 29, in overeenkomstig de artikelen 65 en 66 van de Procedureverordening op grond van artikel 14 van de Kwalificatieverordening.

2.

Onze Minister trekt de verblijfsvergunning asiel, bedoeld in artikel 29a, in overeenkomstig de artikelen 65 en 66 van de Procedureverordening op grond van artikel 19 van de Kwalificatieverordening.

3.

Bij toepassing van het eerste, tweede of zesde lid, trekt Onze Minister gelijktijdig de verblijfsvergunning asiel, bedoeld in de artikelen 29b, 29c of 29d, in die is verleend aan het gezinslid van de vreemdeling wiens verblijfsvergunning asiel met toepassing van het eerste of tweede lid is ingetrokken of ten aanzien van wie toepassing is gegeven aan het zesde lid.

4.

Onze Minister kan de verblijfsvergunning asiel, bedoeld in artikel 29b, voorts intrekken in de gevallen bedoeld in artikel 23, derde tot en met vijfde lid, van de Kwalificatieverordening.

5.

Onze Minister kan de verblijfsvergunning asiel, bedoeld in de artikelen 29c en 29d voorts intrekken, indien:

a.

de vreemdeling onjuiste gegevens heeft verstrekt dan wel gegevens heeft achtergehouden terwijl die gegevens tot afwijzing van de oorspronkelijke aanvraag tot het verlenen zouden hebben geleid;

b.

de vreemdeling een gevaar vormt voor de openbare orde of nationale veiligheid;

c.

de gronden voor verlening, bedoeld in de artikelen 29c of 29d, zijn komen te vervallen;

d.

het gezinslid niet of niet langer een werkelijk huwelijks- of gezinsleven onderhoudt met de vreemdeling die internationale bescherming geniet en die houder is van de verblijfsvergunning asiel, bedoeld in de artikelen 29 of 29a.

6.

Bij de afsluiting, bedoeld in artikel 66, zesde lid, van de Procedureverordening, vermeldt Onze Minister dat in het dossier van de vreemdeling en vermeldt hij daarbij de rechtsgrond voor die afsluiting.

7.

Bij of krachtens algemene maatregel van bestuur kunnen regels worden gesteld over dit artikel.

By decisions of 6 May 2022, the State Secretary for Justice and Security revoked the fixed-term asylum residence permits granted to the parties concerned. The parties concerned constitute a family consisting of two parents and their two adult daughters. They hold Iranian nationality. On 7 August 2017, the Minister granted the mother and the two daughters a fixed-term asylum residence permit pursuant to Article 29, paragraph 1, opening words and under (a), of the Aliens Act 2000 (Vw 2000), as he deemed it credible that they had converted. The father subsequently joined his family, and on 29 March 2018, the Minister granted him a fixed-term asylum residence permit pursuant to Article 29, paragraph 2, opening words and under (a), of the Vw 2000. In the decisions of 6 May 2022, the Minister took the position that the parties concerned had provided false statements with the assistance of the legal advisor. This ruling concerns the question of whether the Minister was entitled to revoke the permits and how a reassessment should take place in a case such as this.

By decisions of 21 December 2023, supplemented on 10 February 2025, the State Secretary for Justice and Security revoked the fixed-term asylum residence permits granted to the appellants. The appellants constitute a family consisting of a mother and her two adult sons. They all possess Iranian nationality. Following an initial rejection of the asylum applications, the Minister subsequently granted the mother and her then-minor son an asylum residence permit with effect from 21 September 2017, pursuant to Article 29, paragraph 1, opening words and under (a), of the Aliens Act 2000 (Vw 2000), because he deemed the mother's problems resulting from her apostasy to be credible. The Minister granted the son, who was already an adult at that time, an independent asylum residence permit pursuant to Article 29, paragraph 1, opening words and under (b), of the Aliens Act 2000, because he deemed the problems of his mother to be credible. In the decision of 21 December 2023, supplemented on 10 February 2025, the Minister took the position that the mother had made false statements with the assistance of the legal advisor. This ruling concerns the question of whether the Minister was entitled to revoke the permits and the question of how a reassessment must take place in a case such as this.

By referral decision of 30 August 2023, ECLI:NL:RVS:2023:3275, the Administrative Jurisdiction Division requested the Court of Justice to give a preliminary ruling on the questions posed by it concerning the processing of asylum applications of persons who have been recognised as refugees by Greece. This ruling concerns the question of how the Minister must handle asylum applications of persons who have been recognised as refugees by another Member State. In this case, Greece was the status-granting Member State.
