The residence permit for an indefinite period, as referred to in Article 20, may be withdrawn if:
the holder thereof has established his habitual residence outside the Netherlands;
the foreign national has provided incorrect data or has withheld data, whereas such data would have led to the rejection of the application for the granting, amendment or extension;
the holder thereof has been convicted by a final and non-appealable judicial sentence for a criminal offence punishable by a term of imprisonment of three years or more, or the measure referred to in Article 37a of the Criminal Code has been imposed on him; or
the foreign national constitutes a danger to national security.
Rules may be laid down by or pursuant to an order in council (algemene maatregel van bestuur) regarding the grounds referred to in paragraph 1.
De verblijfsvergunning voor onbepaalde tijd, bedoeld in artikel 20, kan worden ingetrokken indien:
de houder daarvan zijn hoofdverblijf buiten Nederland heeft gevestigd;
de vreemdeling onjuiste gegevens heeft verstrekt dan wel gegevens heeft achtergehouden terwijl die gegevens tot afwijzing van de aanvraag tot het verlenen, wijzigen of verlengen zouden hebben geleid;
de houder daarvan bij onherroepelijk geworden rechterlijk vonnis is veroordeeld wegens een misdrijf waartegen een gevangenisstraf van drie jaren of meer is bedreigd, dan wel hem terzake de maatregel, bedoeld in artikel 37a van het Wetboek van Strafrecht, is opgelegd; of
de vreemdeling een gevaar vormt voor de nationale veiligheid.
Bij of krachtens algemene maatregel van bestuur kunnen regels worden gesteld over de gronden, bedoeld in het eerste lid.

By decision of 24 April 2019, the State Secretary for Justice and Security revoked the ordinary residence permit for an indefinite period granted to the appellant and issued an entry ban against him. The appellant states that he originates from North Macedonia. He has had lawful residence in the Netherlands since 10 October 1989. With effect from 4 September 1995, he has held an ordinary residence permit for an indefinite period. The Minister revoked this residence permit with retroactive effect to 26 February 2013 for reasons of public order pursuant to Article 22, second paragraph, opening words and under (c), of the Aliens Act 2000 (Vreemdelingenwet 2000) and Article 3.86, fourth and fifth paragraphs, of the Aliens Decree 2000 (Vreemdelingenbesluit 2000). The Minister based this on information from the Judicial Information Service (Justitiële Informatiedienst) showing that the appellant has been irrevocably convicted of more than three offences carrying a prison sentence of three years or more.

The Division has thereby stayed the proceedings on the appeals until the Court has rendered its judgment and reserved any further consideration. The foreign national holds Turkish nationality and has resided lawfully in the Netherlands since 15 February 1983, thus for more than twenty years. It is not in dispute that he derives rights from Article 7 of Decision No. 1/80 and has a corresponding right of residence. The State Secretary has terminated the right of residence because the foreign national poses a threat to public order.
