1. Not later than 20 August 2011, the Commission shall submit to the European Parliament, the Council and the European Economic and Social Committee a report on the application of this Regulation. If necessary, the report shall be accompanied by proposals to adapt this Regulation. The report shall include:
(i) a study on the effects of the way in which foreign law is treated in the different jurisdictions and on the extent to which courts in the Member States apply foreign law in practice pursuant to this Regulation;
(ii) a study on the effects of Article 28 of this Regulation with respect to the Hague Convention of 4 May 1971 on the law applicable to traffic accidents.
2. Not later than 31 December 2008, the Commission shall submit to the European Parliament, the Council and the European Economic and Social Committee a study on the situation in the field of the law applicable to non-contractual obligations arising out of violations of privacy and rights relating to personality, taking into account rules relating to freedom of the press and freedom of expression in the media, and conflict-of-law issues related to Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (7).
1. Uiterlijk op 20 augustus 2011 brengt de Commissie aan het Europees Parlement, de Raad en het Europees Economisch en Sociaal Comité verslag uit over de toepassing van deze verordening. Het verslag gaat indien nodig vergezeld van voorstellen tot aanpassing van deze verordening. Dit verslag bevat:
i) een studie naar de gevolgen van de wijze waarop het vreemde recht in de verschillende rechtsgebieden wordt behandeld en over de mate waarin de rechters in de lidstaten vreemd recht in de praktijk overeenkomstig deze verordening toepassen;
ii) een studie naar de gevolgen van artikel 28 van deze verordening met betrekking tot het Verdrag inzake de wet welke van toepassing is op verkeersongevallen op de weg, gedaan te 's-Gravenhage op 4 mei 1971.
2. Uiterlijk op 31 december 2008 legt de Commissie aan het Europees Parlement, de Raad en het Europees Economisch en Sociaal Comité een studie voor naar de situatie op het gebied van het recht dat van toepassing is op niet-contractuele verbintenissen die voortvloeien uit inbreuken op de persoonlijke levenssfeer en op de persoonlijkheidsrechten, met inachtneming van regels inzake persvrijheid en vrijheid van meningsuiting in de media en kwesties inzake collisie in verband met Richtlijn 95/46/EG van het Europees Parlement en de Raad van 24 oktober 1995 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens (7).
