Where the Office finds that the loss of any rights results from this Regulation or acts adopted pursuant to this Regulation, without any decision having been taken, it shall communicate this to the person concerned in accordance with Article 98. The latter may apply for a decision on the matter within two months of notification of the communication, if he considers that the finding of the Office is incorrect. The Office shall adopt such a decision only where it disagrees with the person requesting it; otherwise the Office shall amend its finding and inform the person requesting the decision.
Wanneer het Bureau tot de bevinding komt dat uit deze verordening of uit overeenkomstig deze verordening vastgestelde handelingen verlies van rechten voortspruit zonder dat hierover enige beslissing is genomen, stelt het overeenkomstig artikel 98 de betrokkene daarvan in kennis. Deze kan verzoeken om een beslissing ter zake binnen twee maanden na de kennisgeving van de mededeling, indien hij van oordeel is dat de bevindingen van het Bureau onjuist zijn. Het Bureau neemt die beslissing alleen wanneer het niet akkoord gaat met de verzoeker, zo niet wijzigt het zijn bevindingen en stelt het de verzoeker daarvan in kennis.
