in forceSPECIFIC PROVISIONS ON EUROPEAN UNION COLLECTIVE MARKS AND CERTIFICATION MARKS
1. An applicant for an EU collective mark shall submit regulations governing use within two months of the date of filing.
2. The regulations governing use shall specify the persons authorised to use the mark, the conditions of membership of the association and, where they exist, the conditions of use of the mark, including sanctions. The regulations governing use of a mark referred to in Article 74(2) shall authorise any person whose goods or services originate in the geographical area concerned to become a member of the association which is the proprietor of the mark.
3. The Commission shall adopt implementing acts specifying the details to be contained in the regulations referred to in paragraph 2 of this Article. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 207(2).
1. De aanvrager van een collectief Uniemerk dient binnen twee maanden na de datum van indiening een reglement in betreffende het gebruik daarvan.
2. Het reglement bepaalt welke personen het merk mogen gebruiken, onder welke voorwaarden iemand tot de vereniging behoort en onder welke voorwaarden, voor zover deze bestaan, met inbegrip van sancties, het merk kan worden gebruikt. Het reglement van een in artikel 74, lid 2, bedoeld merk moet het lidmaatschap van de vereniging die houder is van dat merk openstellen voor eenieder wiens waren uit het betrokken geografische gebied afkomstig zijn.
3. De Commissie stelt uitvoeringshandelingen vast met betrekking tot de in lid 2 van dit artikel bedoelde nadere gegevens die moeten worden opgenomen in het reglement. Die uitvoeringshandelingen worden vastgesteld volgens de in artikel 207, lid 2, bedoelde onderzoeksprocedure.
