Article 184

1. The international application shall be filed in one of the official languages of the Union, using a form provided by the Office. The Office shall inform the applicant filing the international application of the date on which the documents making up the international application are received by the Office. Unless otherwise specified by the applicant on form when he files the international application, the Office shall correspond with the applicant in the language of filing in a standard form.
2. If the international application is filed in a language which is not one of the languages allowed under the Madrid Protocol, the applicant shall indicate a second language from among those languages. This shall be the language in which the Office submits the international application to the International Bureau.
3. Where the international application is filed in a language other than one of the languages allowed under the Madrid Protocol for the filing of international applications, the applicant may provide a translation of the list of goods or services and of any other textual elements forming part of the international application in the language in which the international application is to be submitted to the International Bureau pursuant to paragraph 2. If the application is not accompanied by such translation, the applicant shall authorise the Office to include that translation in the international application. Where the translation has not yet been established in the course of the registration procedure for the EU trade mark application on which the international application is based, the Office shall, without delay, arrange for the translation.
4. The filing of an international application shall be subject to the payment of a fee to the Office. Where the international registration is to be based on an EU trade mark once it is registered, the fee shall be due on the date of registration of the EU trade mark. The application shall be deemed not to have been filed until the required fee has been paid. Where the fee has not been paid, the Office shall inform the applicant accordingly. In the event of electronic filing, the Office may authorise the International Bureau to collect the fee on its behalf.
5. Where the examination of the international application reveals any of the following deficiencies, the Office shall invite the applicant to remedy those deficiencies within such period as it may specify:
(a) the international application has not been filed using the form referred to in paragraph 1, and does not contain all the indications and information required by that form;
(b) the list of goods and services contained in the international application is not covered by the list of goods and services appearing in the basic EU trade mark application or basic EU trade mark;
(c) the mark which is subject to the international application is not identical with the mark as it appears in the basic EU trade mark application or basic EU trade mark;
(d) an indication in the international application as to the trade mark, other than a disclaimer or a colour claim, does not also appear in the basic EU trade mark application or basic EU trade mark;
(e) where colour is claimed in the international application as a distinctive feature of the mark, the basic EU trade mark application or basic EU trade mark is not in the same colour or colours; or
(f) according to the indications made in the international form, the applicant is not eligible to file an international application through the Office in accordance with Article 2(1)(ii) of the Madrid Protocol.
6. Where the applicant has failed to authorise the Office to include a translation as provided for in paragraph 3, or where it is otherwise unclear on which list of goods and services the international application is to be based, the Office shall invite the applicant to make the required indications within such period as it may specify.
7. If the deficiencies referred to in paragraph 5 are not remedied or the required indications referred to in paragraph 6 are not given within the period fixed by the Office, the Office shall refuse to forward the international application to the International Bureau.
8. The Office shall forward the international application to the International Bureau along with the certification provided for under Article 3(1) of the Madrid Protocol as soon as the international application meets the requirements laid down in this Article, the implementing act adopted pursuant to paragraph 9 of this Article, and in Article 183 of this Regulation.
9. The Commission shall adopt implementing acts specifying the exact form, including the elements thereof, to be used for the filing of an international application pursuant to paragraph 1. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 207(2).
1. De internationale aanvraag wordt ingediend in een van de officiële talen van de Unie, met gebruikmaking van een formulier dat door het Bureau wordt verstrekt. Het Bureau stelt de indiener van de internationale aanvraag in kennis van de datum waarop het Bureau de documenten ontvangen heeft die de internationale aanvraag uitmaken. Tenzij de aanvrager bij de indiening van de internationale aanvraag op dat formulier iets anders heeft aangegeven, voert het Bureau een gestandaardiseerde briefwisseling met de aanvrager in de taal van de aanvraag.
2. Indien de internationale aanvraag wordt ingediend in een taal die niet een van de talen is die overeenkomstig het Protocol van Madrid zijn toegestaan, moet de aanvrager een van deze talen opgeven als tweede taal. Deze tweede taal wordt de taal waarin het Bureau de internationale aanvraag bij het Internationale Bureau indient.
3. Indien de internationale aanvraag wordt ingediend in een andere taal dan een van de talen die overeenkomstig het Protocol van Madrid voor de indiening van internationale aanvragen zijn toegestaan, kan de aanvrager een vertaling verstrekken van de lijst van waren of diensten en van andere tekstgedeelten van de internationale aanvraag in de taal waarin de internationale aanvraag krachtens lid 2 bij het Internationale Bureau moet worden ingediend. Indien de aanvraag niet vergezeld gaat van een dergelijke vertaling, staat de aanvrager toe dat het Bureau een vertaling opneemt in de internationale aanvraag. Indien geen vertaling is verstrekt in de loop van de procedure voor inschrijving van het Uniemerk waarop de internationale aanvraag is gebaseerd, voorziet het Bureau onverwijld in een vertaling.
4. Bij de indiening van een internationale aanvraag moet een taks aan het Bureau worden betaald. Indien de internationale inschrijving op een Uniemerk moet worden gebaseerd zodra dit is ingeschreven, is de taks verschuldigd op de datum van inschrijving van het Uniemerk. De aanvraag wordt pas geacht te zijn ingediend nadat de verschuldigde taks is betaald. Indien de taks niet is betaald, stelt het Bureau de aanvrager daarvan in kennis. In geval van elektronische indiening kan het Bureau toestaan dat het Internationale Bureau de taks namens het Bureau int.
5. Wanneer uit onderzoek van de internationale aanvraag één of meer van de volgende gebreken naar voren komt, verzoekt het Bureau de aanvrager die gebreken binnen een gegeven termijn te verhelpen:
a) de internationale aanvraag is niet ingediend met gebruikmaking van het in lid 1 bedoelde formulier en bevat niet alle aanduidingen en informatie die dat formulier vereist;
b) de lijst van waren en diensten in de internationale aanvraag strookt niet met de lijst van waren en diensten in de basisaanvraag voor een Uniemerk of het basis-Uniemerk;
c) het merk dat het voorwerp vormt van de internationale aanvraag verschilt van het merk dat voorkomt in de basisaanvraag voor of de basisinschrijving van het Uniemerk
d) in de internationale aanvraag staat een aanduiding inzake het merk, waarbij het niet gaat om een verklaring van afwijzing of aanspraak op een kleur, die niet voorkomt in de basisaanvraag voor of de basisinschrijving van het Uniemerk;
e) in de internationale aanvraag wordt gesteld dat de kleur een onderscheidend kenmerk van het merk vormt, maar in de basisaanvraag voor of de basisinschrijving van het Uniemerk zijn andere kleuren gebruikt, of
f) volgens de aanduidingen in het internationale formulier is de aanvrager niet gerechtigd overeenkomstig artikel 2, lid 1, onder ii), van het Protocol van Madrid een internationale aanvraag in te dienen bij het Bureau.
6. Wanneer de aanvrager niet heeft toegestaan dat het Bureau een vertaling als bedoeld in lid 3 opneemt, of het anderszins onduidelijk is op welke lijst van waren en diensten de internationale aanvraag is gebaseerd, verzoekt het Bureau de indiener de vereiste aanduidingen aan te brengen binnen een gegeven termijn.
7. Indien de in lid 5 bedoelde gebreken niet zijn verholpen of de in lid 6 bedoelde vereiste aanduidingen niet zijn aangebracht binnen de door het Bureau vastgestelde termijn, weigert het Bureau de internationale aanvraag toe te zenden aan het Internationale Bureau.
8. Het Bureau zendt de internationale aanvraag samen met de in artikel 3, lid 1, van het Protocol van Madrid bedoelde verklaring, toe aan het Internationale Bureau zodra de internationale aanvraag voldoet aan de vereisten van het onderhavige artikel, van de krachtens lid 9 van dit artikel vastgestelde uitvoeringshandeling, en van artikel 183 van deze verordening.
9. De Commissie stelt uitvoeringshandelingen vast met betrekking tot de juiste vorm, met inbegrip van de bestanddelen daarvan, waarin de internationale aanvraag krachtens lid 1 moet worden ingediend. Die uitvoeringshandelingen worden vastgesteld volgens de in artikel 207, lid 2, bedoelde onderzoeksprocedure.
