1. A counterclaim for revocation or for a declaration of invalidity may only be based on the grounds for revocation or invalidity mentioned in this Regulation.

2. An EU trade mark court shall reject a counterclaim for revocation or for a declaration of invalidity if a decision taken by the Office relating to the same subject matter and cause of action and involving the same parties has already become final.

3. If the counterclaim is brought in a legal action to which the proprietor of the trade mark is not already a party, he shall be informed thereof and may be joined as a party to the action in accordance with the conditions set out in national law.

4. The EU trade mark court with which a counterclaim for revocation or for a declaration of invalidity of the EU trade mark has been filed shall not proceed with the examination of the counterclaim, until either the interested party or the court has informed the Office of the date on which the counterclaim was filed. The Office shall record that information in the Register. If an application for revocation or for a declaration of invalidity of the EU trade mark had already been filed before the Office before the counterclaim was filed, the court shall be informed thereof by the Office and stay the proceedings in accordance with Article 132(1) until the decision on the application is final or the application is withdrawn.

5. Article 64(2) to (5) shall apply.

6. Where an EU trade mark court has given a judgment which has become final on a counterclaim for revocation or for a declaration of invalidity of an EU trade mark, a copy of the judgment shall be sent to the Office without delay, either by the court or by any of the parties to the national proceedings. The Office or any other interested party may request information about such transmission. The Office shall mention the judgment in the Register and shall take the necessary measures to comply with its operative part.

7. The EU trade mark court hearing a counterclaim for revocation or for a declaration of invalidity may stay the proceedings on application by the proprietor of the EU trade mark and after hearing the other parties and may request the defendant to submit an application for revocation or for a declaration of invalidity to the Office within a time limit which it shall determine. If the application is not made within the time limit, the proceedings shall continue; the counterclaim shall be deemed withdrawn. Article 132(3) shall apply.

1. De reconventionele vordering tot vervallenverklaring of nietigverklaring kan slechts steunen op de in deze verordening genoemde gronden voor vervallen- of nietigverklaring.

2. Een rechtbank voor het Uniemerk verwerpt een reconventionele vordering tot vervallenverklaring of nietigverklaring indien op een vordering met hetzelfde voorwerp en op dezelfde grond al door het Bureau tussen dezelfde partijen een onherroepelijke beslissing is gegeven.

3. Indien de reconventionele vordering wordt ingesteld in een procedure waarin de merkhouder nog geen partij is, wordt hij daarvan in kennis gesteld en kan hij zich in het geding voegen overeenkomstig het nationale recht.

4. De rechtbank voor het Uniemerk waarbij een reconventionele vordering tot vervallen- of nietigverklaring van een Uniemerk is ingesteld, gaat niet over tot het onderzoek van de reconventionele vordering voordat de belanghebbende partij of de rechtbank het Bureau in kennis heeft gesteld van de datum van instelling van de reconventionele vordering. Het Bureau maakt hiervan melding in het register. Indien reeds bij het Bureau een vordering tot vervallen- of nietigverklaring van het Uniemerk was ingesteld alvorens de reconventionele vordering werd ingesteld, wordt de rechtbank door het Bureau hiervan in kennis gesteld en wordt de procedure overeenkomstig artikel 132, lid 1, geschorst totdat de beslissing over de vordering in kracht van gewijsde is gegaan of de vordering is ingetrokken.

5. Artikel 64, leden 2 tot en met 5, is van toepassing.

6. Wanneer een rechtbank voor het Uniemerk een in kracht van gewijsde gegane beslissing over een reconventionele vordering tot vervallen- of nietigverklaring van het Uniemerk heeft gewezen, wordt door de rechtbank of door een partij in de nationale procedure onverwijld een afschrift van de beslissing aan het Bureau toegezonden. Het Bureau of een andere belanghebbende partij kan verzoeken om informatie over de toezending. Het Bureau vermeldt de beslissing in het register en neemt de nodige maatregelen om zich te voegen naar het dictum.

7. Indien bij een rechtbank voor het Uniemerk een reconventionele vordering tot vervallenverklaring of nietigverklaring wordt ingesteld, kan zij, de andere partijen gehoord, de procedure schorsen op verzoek van de houder van het Uniemerk en de verweerder uitnodigen om binnen een door haar te bepalen termijn bij het Bureau een vordering tot vervallenverklaring of nietigverklaring in te stellen. Indien deze vordering niet binnen de bepaalde termijn wordt ingesteld, wordt de procedure voortgezet; de reconventionele vordering wordt dan als ingetrokken beschouwd. Artikel 132, lid 3, is van toepassing.
