3.1 Conditions for the issuance of a residence document for permanent residence
UK national and family members
The IND shall issue a residence document for permanent residence on the basis of Articles 18 and 19 of the Withdrawal Agreement to the UK national and his family member:
who satisfy the criteria of Article 15, paragraph 1 of the withdrawal agreement; and
who, on the basis of Article 18, paragraph 1, under (i) of the Withdrawal Agreement, possess a valid document for border crossing.
Ad a en b.
The IND shall issue a residence document if the UK national and their family member qualify for a right of permanent residence pursuant to Article 15 of the Withdrawal Agreement and therefore satisfy Articles 16, 17, and 18 of Directive 2004/38/EC, as further elaborated in Articles 8.17 through 8.25 of the Aliens Decree (Vreemdelingenbesluit) and the policy rules as referred to in the part of paragraph B10/2 of the Aliens Act Implementation Guidelines (Vreemdelingencirculaire) that pertains to Articles 8.17 through 8.25 of the Aliens Decree.
On the basis of the principle of free evaluation of evidence (vrije bewijsleer), the UK national and his family member may demonstrate this by all means of evidence.
The IND shall ex officio assess against the conditions as set out in paragraph B13/2.1 Vc if the UK national and his family member do not hold a residence permit as referred to in paragraph B13/2.1 Vc and they do not satisfy the conditions of Article 15, first paragraph of the withdrawal agreement.
3.2 Contra-indications
The IND shall not grant a residence document as referred to in paragraph B13/3.1 Vc if one of the following contra-indications applies:
the UK national or the family member poses a threat to public policy (including Article 1F of the Refugee Convention) or public security as referred to in Article 20 of the withdrawal agreement and mentioned in Articles 27 and 28 of Directive 2004/38/EC;
the UK national or the family member is guilty of abuse of rights or fraud as referred to in Article 20 of the withdrawal agreement and mentioned in Article 35 of Directive 2004/38/EC;
the UK national or their family member has been absent from the Netherlands for more than five consecutive years as described in Article 11 of the withdrawal agreement.
Sub a.
Danger to public order and national security
Pursuant to Article 20, paragraph 1 of the Withdrawal Agreement, the provisions of Chapter 6 of Directive 2004/38/EC shall apply to offences committed up to and including 31 December 2020. This implies that the public policy criterion of paragraph B10/2.8.6 of the Aliens Circular (Vreemdelingencirculaire) applies to these offences. With regard to offences committed after 31 December 2020, the national public policy provisions shall apply pursuant to Article 20, paragraph 2 of the Withdrawal Agreement.
The IND shall likewise not grant a residence document if there are concrete indications that the UK national or the family member constitutes a threat to national security within the meaning of paragraph B1/4.4 Vc, pursuant to Article 27 of Directive 2004/38/EC. If a threat to public policy (or a threat to national security) exists only in respect of the UK national, the IND shall, in view of the dependent nature of the right of residence, grant a residence document as referred to in paragraph B13/3.1 Vc neither to the UK national nor to the family member. If this contra-indication exists only in respect of the family member, the IND shall refuse to grant a residence document solely to that family member.
The IND shall also not issue a residence document if a procedure is pending to assess whether the UK national or the family member poses a threat to public order, regardless of the date of the offence.
The IND systematically carries out public policy checks pursuant to Article 18, paragraph 1, subparagraph (p) of the Withdrawal Agreement when assessing applications for a residence document as referred to in paragraph B13/3.1 Vc to determine whether the restrictions of Article 20 of the Withdrawal Agreement apply.
Ad b.
The provisions of paragraph B10/2.8.5 Vc under the heading ‘Abuse of law and fraud’ shall apply here mutatis mutandis.
3.3 Holders of an EU document for permanent residence
The IND shall exchange, free of charge, the existing residence document EU permanent (EU duurzaam) as referred to in Article 16 of Directive 2004/38/EC for a residence document as referred to in paragraph B13/3.1 Vc for UK nationals and their family members who, on 31 December 2020, are in possession of an EU document for permanent residence as referred to in Article 18, paragraph 1, under (h) of the Withdrawal Agreement after:
verification of the identity;
control on public order and national security; and
monitoring of the uninterrupted nature of the stay.
3.4 Procedural provisions
3.4.1 Application procedure if a residence document as referred to in paragraph B13/2.1 Vc has not been granted previously
The UK national and his family member must submit an application to be eligible for a residence document as referred to in paragraph B13/3.1 Vc, so that, upon the granting of the application, they shall possess proof of lawful residence after the transition period.
Pursuant to Article 18, paragraph 1, subparagraph (b), first subparagraph, of the withdrawal agreement, the UK national and his family member who arrived in the Netherlands before the end of the transition period may still submit an application after 31 December 2020. In that case, the UK national and his family member shall have the opportunity to submit an application for a residence document as referred to in paragraph B13/3.1 Vc up to and including 30 September 2021 (nine months after the end of the transition period) at the latest.
Exceeding the time limit
Brexit has profound consequences for the right of residence and social implications in the event that a new residence document is not applied for in a timely manner. Therefore, from the perspective of proportionality, an application from a UK national and their family member, who resided in the Netherlands before the end of the transition period (31 December 2020) and who submits an application after 30 September 2021, shall still be considered on its merits for a period of one year (until 1 October 2022), regardless of the reason for the late submission. Consequently, the assessment of the existence of excusable grounds for the late application shall be omitted during this period.
If the UK national (and their family member) has not submitted an application for the issuance of a residence document (as referred to in paragraph B13/3.1 Vc) by 30 September 2021 at the latest, they shall, as of 1 October 2021, no longer have lawful residence in the Netherlands based on the withdrawal agreement. However, if the UK national (and their family member) subsequently submits the application before 1 October 2022, the UK national (and the family member) shall, upon the granting of the application, nevertheless regain the right of residence based on the withdrawal agreement with retroactive effect from 1 October 2021.
For applications submitted after 30 September 2022, the IND assesses, on the basis of Article 18, paragraph 1, under (d) of the Withdrawal Agreement, whether there are excusable reasons why the application was not submitted within the time limit. In assessing whether there is an excusable failure to meet the time limit, the IND takes into account all relevant facts and circumstances. Only if the IND concludes that the application was submitted late for excusable reasons will the conditions of B13/3.1 Vc be assessed.
3.4.2 Application procedure if a residence document as referred to in paragraph B13/2.1 Vc has previously been granted to the UK national and his family member
The UK national and their family member who are already in possession of a right of residence as referred to in paragraph B13/2.1 Vc, shall acquire a permanent right of residence if they satisfy the conditions as referred to in paragraph B13/3.1 Vc. In that case, they may submit an application for the grant of a residence document as referred to in paragraph B13/3.1 Vc. No final deadline shall apply to this application.
After the submission of the application, the IND shall assess whether the UK national and their family member satisfy the conditions as set forth in paragraph B13/3.1 Vc. Upon the granting of the application, they shall receive from the IND a residence document as referred to in paragraph B13/3.1 Vc. With this residence document, they can demonstrate that they are in possession of a right of permanent residence as referred to in paragraph B13/3.1 Vc.
3.4.3 Restriction and labour market endorsement
The IND shall issue the residence document with reference to the Withdrawal Agreement. The text on the residence document shall read: ‘Permanent residence document Withdrawal Agreement’. The labour market endorsement shall read: ‘Employment freely permitted, work permit (TWV) not required’.
3.4.4 Effective date and period of validity of the residence document
The IND shall grant the residence document as referred to in paragraph B13/3.1 Vc with effect from the day on which the application is decided. The IND shall grant the residence document for a duration of 10 years.
3.5 Termination of the right of residence
The IND shall terminate the right of residence of the UK national and their family member if the grounds for termination of Article 20 of the Withdrawal Agreement apply. The IND shall also terminate the right of residence on the basis of Article 15, paragraph 3, of the Withdrawal Agreement in the event of absence from the Netherlands for a period of more than five years. The IND shall terminate the right of residence as referred to in paragraph B13/3.1 Vc with retroactive effect in the event of abuse of rights or if incorrect information has been provided while knowledge of the correct information would have led to the refusal of the residence document, as described in paragraph B10/2.8.5 Vc.
If, after the granting of the residence permit as referred to in paragraph B13/3.1 Vc, new circumstances arise during the transition period on the basis of which the right of residence may be withdrawn, the provisions of Chapter 6 of Directive 2004/38/EC shall apply. In cases of public policy, the date of the offence shall be leading. If the offence was committed on or before 31 December 2020, the public policy criterion as referred to in paragraph B10/2.8.6 Vc shall apply. If the offence was committed after 31 December 2020, the public policy criterion as referred to in paragraph B1/6 Vc shall apply.
3.1 Voorwaarden voor verlening van een verblijfsdocument voor duurzaam verblijf
VK-onderdaan en familieleden
De IND verleent een verblijfsdocument voor duurzaam verblijf op grond van artikel 18 en 19 van het terugtrekkingsakkoord aan de VK-onderdaan en zijn familielid:
die voldoen aan de criteria van artikel 15, eerste lid van het terugtrekkingsakkoord; en
die op grond van artikel 18, eerste lid onder i van het terugtrekkingsakkoord beschikken over een geldig document voor grensoverschrijding.
Ad a en b.
De IND verstrekt een verblijfsdocument indien de VK-onderdaan en zijn familielid voor duurzaam verblijfsrecht op grond van artikel 15 van het terugtrekkingsakkoord in aanmerking komen en derhalve voldoen aan de artikelen 16, 17 en 18 van de richtlijn 2004/38/EG, nader uitgewerkt in de artikelen 8.17 t/m 8.25 Vb en de beleidsregels als bedoeld in het deel van paragraaf B10/2 Vc dat ziet op de artikelen 8.17 t/m 8.25 Vb.
Op grond van de vrije bewijsleer kunnen de VK-onderdaan en zijn familielid dit met alle bewijsmiddelen aantonen.
De IND toetst ambtshalve aan de voorwaarden als vermeld in paragraaf B13/2.1 Vc als de VK onderdaan en zijn familielid geen verblijfsvergunning hebben als bedoeld in paragraaf B13/2.1 Vc en zij niet voldoen aan de voorwaarden van artikel 15, eerste lid van het terugtrekkingsakkoord.
3.2 Contra-indicaties
De IND verleent geen verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc als er sprake is van een van de volgende contra-indicaties:
de VK-onderdaan of het familielid vormt een gevaar voor de openbare orde (inclusief artikel 1F van het Vluchtelingenverdrag) of de openbare veiligheid zoals bedoeld in artikel 20 van het terugtrekkingsakkoord en genoemd in de artikelen 27 en 28 van richtlijn 2004/38/EG;
de VK-onderdaan of het familielid maakt zich schuldig aan rechtsmisbruik of fraude zoals bedoeld in artikel 20 van het terugtrekkingsakkoord en genoemd in artikel 35 van richtlijn 2004/38/EG;
de VK-onderdaan of zijn familielid zijn meer dan vijf achtereenvolgende jaren uit Nederland afwezig geweest zoals omschreven in artikel 11 van het terugtrekkingsakkoord.
Ad a.
Gevaar voor de openbare orde en de nationale veiligheid
Op grond van artikel 20, eerste lid van het terugtrekkingsakkoord gelden, voor misdrijven gepleegd tot en met 31 december 2020, de bepalingen van hoofdstuk 6 van richtlijn 2004/38/EG. Dit houdt in dat op deze misdrijven het openbare orde criterium van paragraaf B10/2.8.6 Vc van toepassing is. Ten aanzien van na 31 december 2020 gepleegde misdrijven, gelden op grond van artikel 20, tweede lid van het terugtrekkingsakkoord de nationale openbare orde bepalingen.
De IND verleent evenmin een verblijfsdocument indien er concrete aanwijzingen zijn dat de VK-onderdaan of het familielid op grond van artikel 27 van de richtlijn 2004/38/EG een gevaar vormt voor de nationale veiligheid als bedoeld in paragraaf B1/4.4 Vc. Als er enkel bij de VK-onderdaan sprake is van een gevaar voor de openbare orde (of gevaar voor de nationale veiligheid) verleent de IND, gelet op het afhankelijke karakter van het verblijfsrecht, noch aan de VK-onderdaan, noch aan het familielid een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc. Als er enkel bij het familielid sprake is van deze contra-indicatie, verleent de IND uitsluitend aan dat familielid geen verblijfsdocument.
De IND verleent ook geen verblijfsdocument als er een procedure aanhangig is om te beoordelen of de VK-onderdaan of het familielid een gevaar vormt voor de openbare orde, ongeacht de pleegdatum.
De IND voert op grond van artikel 18, eerste lid onder p van het terugtrekkingsakkoord systematisch controles ten aanzien van openbare orde uit bij de beoordeling van aanvragen voor een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc om te bezien of de beperkingen van artikel 20 van het terugtrekkingsakkoord van toepassing zijn.
Ad b.
De bepalingen van paragraaf B10/2.8.5 Vc onder het kopje ‘Rechtsmisbruik en fraude’ zijn hier van overeenkomstige toepassing.
3.3 Houders van een EU document duurzaam verblijf
De IND wisselt kosteloos het bestaande verblijfsdocument EU duurzaam als bedoeld in artikel 16 van richtlijn 2004/38/EG om voor een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc aan VK-onderdanen en hun familieleden die op 31 december 2020 in het bezit zijn van een EU-document duurzaam verblijf als bedoeld in artikel 18, eerste lid onder h van het terugtrekkingsakkoord na:
verificatie van de identiteit;
controle op openbare orde en nationale veiligheid; en
controle op het ononderbroken karakter van het verblijf.
3.4 Procedurele bepalingen
3.4.1 Aanvraagprocedure indien niet eerder een verblijfsdocument is verleend als bedoeld in paragraaf B13/2.1 Vc
De VK-onderdaan en zijn familielid moeten een aanvraag indienen om in aanmerking te komen voor een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc, zodat zij bij inwilliging van de aanvraag na de overgangsperiode een bewijs van rechtmatig verblijf hebben.
Op grond van artikel 18, eerste lid onder b, eerste alinea, van het terugtrekkingsakkoord kunnen de VK-onderdaan en zijn familielid die vóór het einde van de overgangsperiode naar Nederland zijn gekomen, ook na 31 december 2020 nog een aanvraag indienen. De VK-onderdaan en zijn familielid hebben in dat geval de gelegenheid om tot en met uiterlijk 30 september 2021 (negen maanden na het einde van de overgangsperiode) een aanvraag voor een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc in te dienen.
Termijnoverschrijding
De Brexit heeft ingrijpende verblijfsrechtelijke en maatschappelijke gevolgen in het geval niet tijdig een nieuw verblijfsdocument wordt aangevraagd. Daarom wordt een aanvraag van een VK-onderdaan en zijn familielid, die vóór het einde van de overgangsperiode (31 december 2020) in Nederland verbleef en die na 30 september 2021 een aanvraag indient nog gedurende één jaar (tot 1 oktober 2022) uit oogpunt van evenredigheid inhoudelijk in behandeling genomen, ongeacht de reden van de te late indiening. De toets op de aanwezigheid van een verschoonbare reden voor de te late aanvraag blijft gedurende deze periode derhalve achterwege.
Als de VK-onderdaan (en zijn familielid) niet uiterlijk op 30 september 2021 een aanvraag heeft ingediend voor verlening van een verblijfsdocument (als bedoeld in paragraaf B13/3.1 Vc), heeft hij vanaf 1 oktober 2021 in Nederland geen rechtmatig verblijf meer op grond van het terugtrekkingsakkoord. Maar als de VK onderdaan (en zijn familielid) daarna vóór 1 oktober 2022 alsnog de aanvraag indient, verkrijgt de VK onderdaan (en het familielid) bij inwilliging van de aanvraag alsnog met terugwerkende kracht vanaf 1 oktober 2021 weer verblijfsrecht op grond van het terugtrekkingsakkoord.
Bij aanvragen ingediend na 30 september 2022 toetst de IND op grond van artikel 18, eerste lid onder d van het terugtrekkingsakkoord of er verschoonbare redenen aanwezig zijn waarom de aanvraag niet binnen de termijn is ingediend. De IND betrekt bij de beoordeling of sprake is van een verschoonbare termijnoverschrijding alle relevante feiten en omstandigheden. Pas als de IND concludeert dat de aanvraag verschoonbaar te laat is ingediend, wordt aan de voorwaarden van B13/3.1 Vc getoetst.
3.4.2 Aanvraagprocedure indien eerder aan de VK onderdaan en zijn familielid een verblijfsdocument is verleend als bedoeld in paragraaf B13/2.1 Vc
De VK-onderdaan en zijn familielid die reeds in het bezit zijn van een verblijfsrecht als bedoeld in paragraaf B13/2.1 Vc, verwerven een duurzaam verblijfsrecht als zij voldoen aan de voorwaarden als bedoeld in paragraaf B13/3.1 Vc. Zij kunnen in dat geval een aanvraag indienen voor verlening van een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc. Voor deze aanvraag geldt dan geen uiterlijke termijn.
De IND toetst na indiening van de aanvraag of de VK-onderdaan en zijn familielid voldoen aan de voorwaarden als vermeld paragraaf B13/3.1 Vc. Bij inwilliging van de aanvraag ontvangen zij van de IND een verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc. Zij kunnen met dit verblijfsdocument aantonen dat zij in het bezit zijn van een duurzaam verblijfsrecht als bedoeld in paragraaf B13/3.1 Vc.
3.4.3 Beperking en arbeidsmarktaantekening
De IND verleent het verblijfsdocument onder verwijzing naar het terugtrekkingsakkoord. De tekst op het verblijfsdocument luidt: ‘Permanent residence document Withdrawal Agreement’. De arbeidsmarktaantekening luidt: ‘Arbeid vrij toegestaan, TWV niet vereist’.
3.4.4 Ingangsdatum en geldigheidsduur van het verblijfsdocument
De IND verleent het verblijfsdocument als bedoeld in paragraaf B13/3.1 Vc met ingang van de dag waarop de aanvraag is beslist. De IND verleent het verblijfsdocument voor de duur van 10 jaar.
3.5 Beeindiging van het verblijfsrecht
De IND beëindigt het verblijfsrecht van de VK-onderdaan en zijn familielid als de beeindigingsgronden van artikel 20 van het terugtrekkingsakkoord van toepassing zijn. De IND beëindigt ook op grond van artikel 15, derde lid van het terugtrekkingsakkoord het verblijfsrecht bij afwezigheid uit Nederland van een periode van meer dan vijf jaar. De IND beëindigt het verblijfsrecht als bedoeld in paragraaf B13/3.1 Vc met terugwerkende kracht bij rechtsmisbruik of indien er onjuiste gegevens zijn verstrekt terwijl bekendheid met de juiste gegevens zou hebben geleid tot weigering van het verblijfsdocument, zoals omschreven in paragraaf B10/2.8.5 Vc.
Indien na de verlening van de verblijfsvergunning als bedoeld in paragraaf B13/3.1Vc zich tijdens de overgangsperiode nieuwe omstandigheden voordoen op grond waarvan het verblijfsrecht kan worden ingetrokken, zijn de bepalingen van hoofdstuk 6 van richtlijn 2004/38/EG van toepassing. Bij openbare orde is de pleegdatum leidend. Als het misdrijf is gepleegd vóór of op 31 december 2020 geldt het openbare orde criterium als bedoeld in paragraaf B10/2.8.6 Vc. Indien het misdrijf ná 31 december 2020 is gepleegd geldt het openbare orde criterium als bedoeld in paragraaf B1/6 Vc.
