2.1 Conditions for the issuance of a residence document
UK national and family members
The IND shall issue a residence document on the basis of Articles 18 and 19 of the Withdrawal Agreement to the UK national and his family member:
who satisfy the criteria of Article 13, paragraph 1 of the withdrawal agreement; and
who, on the basis of Article 18, paragraph 1, under (i) of the Withdrawal Agreement, possess a valid document for border crossing.
Ad a and b.
The IND shall issue a residence document if the UK national and their family member qualify for a right of residence pursuant to Article 13 of the Withdrawal Agreement and therefore satisfy Articles 6, 7 and 14 of Directive 2004/38/EC. These articles are further elaborated in Articles 8.7 to 8.25 inclusive of the Aliens Decree (Vreemdelingenbesluit) (apart from the provisions relating to the right of permanent residence) and the policy rules relating to EU law, as referred to in the part of paragraph B10/2 of the Aliens Act Implementation Guidelines (Vreemdelingencirculaire) that relates to Articles 8.7 to 8.25 inclusive of the Aliens Decree.
On the basis of the principle of free evaluation of evidence (vrije bewijsleer), the UK national and his family member may demonstrate this by all means of evidence.
2.2 Contraindications
The IND shall not grant a residence document as referred to in paragraph B13/2.1 Vc if one of the following contra-indications, mentioned in Article 20 of the Withdrawal Agreement, applies to the UK national or a family member:
the UK national or the family member poses a threat to public policy (including Article 1F of the Refugee Convention) or public security as described in Articles 27 and 28 of Directive 2004/38/EC;
the UK national or the family member is guilty of abuse of rights or fraud as described in Article 35 of Directive 2004/38/EC.
Sub a.
Danger to public order and public safety
Pursuant to Article 20, paragraph 1 of the Withdrawal Agreement, the provisions of Chapter 6 of Directive 2004/38/EC shall apply to offences committed up to and including 31 December 2020. This implies that the public policy criterion of paragraph B10/2.8.6 of the Aliens Circular (Vreemdelingencirculaire) applies to these offences.
For offences committed after 31 December 2020, the national public policy provisions shall apply pursuant to Article 20, paragraph 2 of the Withdrawal Agreement. Depending on the prior residence situation, this means:
assessment against the provisions concerning first admission (Articles 3.77 and 3.78 of the Aliens Decree (Vreemdelingenbesluit) and paragraph B1/4.4 of the Aliens Circular (Vreemdelingencirculaire));
assessment against the provisions regarding the continuation of the previous right of residence (Articles 3.86 and 3.87 of the Aliens Decree (Vreemdelingenbesluit) and paragraphs B1/6.2 and B1/6.2.2 of the Aliens Act Implementation Guidelines (Vreemdelingencirculaire)).
The IND shall likewise not grant a residence document if there are concrete indications that the UK national or the family member constitutes a threat to national security in accordance with Article 27 of Directive 2004/38/EC (see paragraph B1/4.4 Vc). In the event that this contraindication applies solely to the UK national, the IND shall, in view of the dependent nature of the right of residence, grant a residence document as referred to in paragraph B13/2.1 Vc neither to the UK national nor to the family member. In the event that this contraindication applies solely to the family member, it is exclusively to that family member that no residence document shall be granted.
The IND shall furthermore not issue a residence document if a procedure is pending to assess whether the UK national or their family member poses a threat to public order or public security, regardless of the date of the offence.
The IND systematically carries out public policy checks pursuant to Article 18, paragraph 1, subparagraph (p) of the Withdrawal Agreement when assessing applications for a residence document as referred to in paragraph B13/2.1 Vc to determine whether the restrictions of Article 20 of the Withdrawal Agreement apply.
Ad b.
The provisions of B10/2.8.5 Vc under the heading ‘Abuse of law and fraud’ are applicable here.
2.3 Procedural provisions
Application procedure
The UK national and their family member must submit an application to be eligible for a residence document as referred to in paragraph B13/2.1 Vc, so that upon the granting of the application, they will possess proof of lawful residence after the transition period.
Pursuant to Article 18, paragraph 1, subparagraph (b), first subparagraph, of the Withdrawal Agreement, the UK national and his family member who arrived in the Netherlands before the end of the transition period may still submit an application after 31 December 2020. In that case, the UK national and his family member shall have the opportunity to submit an application for a residence document as referred to in paragraph B13/2.1 Vc up to and including 30 September 2021 (nine months after the end of the transition period) at the latest.
The family member of a UK national, as referred to in Article 10, paragraph 1, under (e), point (ii) and Article 10, paragraphs 3 and 4, of the Withdrawal Agreement, who has the right to commence their residence after 31 December 2020, has the right, pursuant to Article 18, paragraph 1, under (b), second subparagraph, of the Withdrawal Agreement, to submit an application for a residence document as referred to in paragraph B13/2.1 Vc no later than three months after entry. This period of three months after entry shall also continue to apply in the event of an entry after 30 September 2021. Furthermore, the family member who entered the Netherlands after 31 December 2020 may, in any event, submit an application for a residence document as referred to in paragraph B13/2.1 Vc up to and including 30 September 2021. The period of 3 months after entry is therefore not applicable as long as the application is submitted no later than 30 September 2021.
Exceeding the time limit
Brexit has far-reaching consequences for the right of residence and social implications in the event that a new residence document is not applied for in a timely manner. Therefore, from the perspective of proportionality, an application from a UK national and their family member, who resided in the Netherlands before the end of the transition period (31 December 2020) and who submits an application after 30 September 2021, shall still be considered substantively for a period of one year (until 1 October 2022), regardless of the reason for the late submission. Consequently, during this period, the assessment of the presence of excusable grounds for the late application shall be omitted.
If the UK national (and their family member) has not submitted an application for the issuance of a residence document (as referred to in paragraph B13/2.1 Vc) by 30 September 2021 at the latest, they shall, as of 1 October 2021, no longer have a right of lawful residence in the Netherlands under the Withdrawal Agreement. However, if the UK national (and their family member) subsequently submits the application before 1 October 2022, the UK national (and the family member) shall, upon the granting of the application, nonetheless acquire a right of residence under the Withdrawal Agreement with retroactive effect from 1 October 2021.
Also for the family member of the UK national who has the right to commence their residence in the Netherlands after 31 December 2020 and who does not submit their application in a timely manner, the application shall still be taken into consideration for a period of one year (until 1 October 2022), regardless of the reason for the late submission. If the family member of the UK national has not submitted an application for the issuance of a residence document as referred to in paragraph B13/2.1 Vc within the final application deadline (as referred to in Article 18, paragraph 1, subparagraph b of the withdrawal agreement), they shall no longer have lawful residence on the basis of the withdrawal agreement as of the first day after the expiry of the final application deadline. However, if the family member of the UK national subsequently submits the application before 1 October 2022, the family member shall, upon the granting of the application, once again acquire a right of residence on the basis of the withdrawal agreement as referred to in paragraph B13/2.1 Vc from the moment of the submission of the application.
For applications submitted after 30 September 2022, the IND shall assess, on the basis of Article 18, paragraph 1, under (d) of the Withdrawal Agreement, whether there are excusable reasons why the application was not submitted within the time limit. In assessing whether there is an excusable failure to meet the deadline, the IND shall take into account all relevant facts and circumstances. Only if the IND concludes that the application was submitted late for excusable reasons shall the conditions of B13/2.1 Vc be assessed.
Restriction and labour market endorsement
The IND shall issue the residence document with reference to the Withdrawal Agreement. The text on the residence document shall read: ‘Residence document Withdrawal Agreement’. The labour market endorsement shall read: ‘Employment freely permitted, work permit (TWV) not required. A (more than supplementary) recourse to public funds may have consequences for your right of residence’.
Effective date and period of validity of the residence document
The IND shall grant the residence document as referred to in paragraph B13/2.1 Vc with effect from the date on which the application was decided upon. The IND shall grant the residence document for a duration of 5 years.
2.4 Termination of the right of residence
Absence from the Netherlands for longer than 6 (or 12) months
The IND shall terminate, on the basis of Article 15, paragraph 2, of the Withdrawal Agreement, the right of residence as referred to in paragraph B13/2.1 Vc if (the family member of) the UK national:
does not reside in the Netherlands on or after 1 October 2023 and that absence from the Netherlands amounts to more than six months per year; or
does not reside in the Netherlands on or after 1 April 2024, if that absence from the Netherlands is related to important reasons such as pregnancy and childbirth, serious illness, study or vocational training and exceeds twelve consecutive months.
Abuse of right or provision of incorrect data
The IND shall terminate the right of residence as referred to in paragraph B13/2.1 Vc with retroactive effect in the event of abuse of rights or if incorrect data have been provided, whereas knowledge of the correct data would have led to the refusal of the residence document (see paragraph B10/2.8.5 Vc).
Public order and public safety
The IND shall terminate the right of residence of the UK national and their family member if the UK national or the family member constitutes a threat to public policy as referred to in Article 20 of the withdrawal agreement.
If, after the granting of the residence permit as referred to in paragraph B13/2.1 Vc, but before the end of the transition period, new circumstances regarding public order arise on the basis of which the right of residence may be revoked, the provisions of Chapter 6 of Directive 2004/38/EC shall apply. In matters of public order, the date of the offence is leading. If the offence was committed on or before 31 December 2020, the public order criterion as referred to in paragraph B10/2.8.6 Vc shall apply. If the offence was committed after 31 December 2020, the public order criterion as referred to in paragraph B1/6 Vc shall apply.
Appeal to general funds
If an economically inactive UK national or their family member makes a claim on public funds, the content of the section ‘Claim on public funds’ of paragraph B10/2.8.1 Vc shall apply with regard to the assessment of the consequences for the right of residence.
Where the term ‘residence’ (verblijf) is used in the section ‘recourse to public funds’ of paragraph B10/2.8.1, the IND, when assessing the duration of the residence of the UK national in the Netherlands, shall include both the (uninterrupted) residence from before and after the end date of the transition period.
Termination of the family law relationship
The right of residence (as referred to in paragraph B13/2.1 Vc) of a family member of a UK national shall terminate if there is no longer a family law relationship as referred to in B13/1 Vc (section ‘Family members of UK nationals’). Unless a circumstance as referred to in Article 12, 13 or 14 of Directive 2004/38/EC (implemented in the Vb in Article 8.15, paragraphs 2 to 5) occurs and the conditions set forth in those articles are met. Where those articles refer to ‘Union citizen’, this shall in this case be read as ‘UK national’.
2.1 Voorwaarden voor verlening van een verblijfsdocument
VK-onderdaan en familieleden
De IND verleent een verblijfsdocument op grond van artikel 18 en 19 van het terugtrekkingsakkoord aan de VK-onderdaan en zijn familielid:
die voldoen aan de criteria van artikel 13, eerste lid van het terugtrekkingsakkoord; en
die op grond van artikel 18, eerste lid onder i van het terugtrekkingsakkoord beschikken over een geldig document voor grensoverschrijding.
Ad a en b.
De IND verstrekt een verblijfsdocument als de VK-onderdaan en zijn familielid voor verblijfsrecht op grond van artikel 13 van het terugtrekkingsakkoord in aanmerking komen en derhalve voldoen aan de artikelen 6, 7 en 14 van de richtlijn 2004/38/EG. Deze artikelen zijn nader uitgewerkt in de artikelen 8.7 t/m 8.25 Vb (afgezien van de bepalingen die zien op duurzaam verblijfsrecht) en de beleidsregels die zien op het recht van de EU, als bedoeld in het deel van paragraaf B10/2 Vc dat ziet op de artikelen 8.7 t/m 8.25 Vb.
Op grond van de vrije bewijsleer kunnen de VK-onderdaan en zijn familielid dit met alle bewijsmiddelen aantonen.
2.2 Contra-indicaties
De IND verleent geen verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc als bij de VK-onderdaan of een familielid sprake is van een van de volgende contra-indicaties, genoemd in artikel 20 van het terugtrekkingsakkoord:
de VK-onderdaan of het familielid vormt een gevaar voor de openbare orde (inclusief artikel 1F van het Vluchtelingenverdrag) of de openbare veiligheid zoals beschreven in de artikelen 27 en 28 van richtlijn 2004/38/EG;
de VK-onderdaan of het familielid maakt zich schuldig aan rechtsmisbruik of fraude zoals beschreven in artikel 35 van richtlijn 2004/38/EG.
Ad a.
Gevaar voor de openbare orde en de openbare veiligheid
Op grond van artikel 20, eerste lid van het terugtrekkingsakkoord gelden, voor misdrijven gepleegd tot en met 31 december 2020, de bepalingen van hoofdstuk 6 van richtlijn 2004/38/EG. Dit houdt in dat op deze misdrijven het openbare orde criterium van paragraaf B10/2.8.6 Vc van toepassing is.
Voor misdrijven gepleegd na 31 december 2020 gelden op grond van artikel 20, tweede lid van het terugtrekkingsakkoord de nationale openbare orde bepalingen. Afhankelijk van de voorafgaande verblijfssituatie, betekent dat:
toetsing aan de bepalingen inzake eerste toelating (artikelen 3.77 en 3.78 Vb en paragraaf B1/4.4 Vc);
toetsing aan de bepalingen inzake de voortzetting van het eerdere verblijfsrecht (artikelen 3.86 en 3.87 Vb en paragrafen B1/6.2 en B1/6.2.2 Vc).
De IND verleent evenmin een verblijfsdocument als er concrete aanwijzingen zijn dat de VK-onderdaan of het familielid overeenkomstig artikel 27 van de richtlijn 2004/38/EG een gevaar vormt voor de nationale veiligheid (zie paragraaf B1/4.4 Vc). In het geval er enkel bij de VK-onderdaan sprake is van deze contra-indicatie verleent de IND, gelet op het afhankelijke karakter van het verblijfsrecht, noch aan de VK-onderdaan, noch aan het familielid een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc. In het geval er enkel bij het familielid sprake is van deze contra-indicatie, wordt uitsluitend aan dat familielid geen verblijfsdocument verleend.
De IND verleent voorts geen verblijfsdocument als er een procedure aanhangig is om te beoordelen of de VK-onderdaan of zijn familielid een gevaar vormt voor de openbare orde of de openbare veiligheid, ongeacht de pleegdatum.
De IND voert op grond van artikel 18, eerste lid onder p van het terugtrekkingsakkoord systematisch controles ten aanzien van openbare orde uit bij de beoordeling van aanvragen voor een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc om te bezien of de beperkingen van artikel 20 van het terugtrekkingsakkoord van toepassing zijn.
Ad b.
De bepalingen van B10/2.8.5 Vc onder het kopje ‘Rechtsmisbruik en fraude’ zijn hier van toepassing.
2.3 Procedurele bepalingen
Aanvraagprocedure
De VK-onderdaan en zijn familielid moeten een aanvraag indienen om in aanmerking te komen voor een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc, zodat zij bij inwilliging van de aanvraag na de overgangsperiode een bewijs van rechtmatig verblijf hebben.
Op grond van artikel 18, eerste lid onder b, eerste alinea, van het terugtrekkingsakkoord kunnen de VK-onderdaan en zijn familielid die vóór het einde van de overgangsperiode naar Nederland zijn gekomen ook na 31 december 2020 nog een aanvraag indienen. De VK-onderdaan en zijn familielid hebben in dat geval de gelegenheid om tot en met uiterlijk 30 september 2021 (negen maanden na het einde van de overgangsperiode) een aanvraag voor een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc in te dienen.
Het familielid van een VK-onderdaan, als bedoeld in artikel 10, eerste lid, onder e,onderdeel ii en artikel 10, derde en vierde lid, van het terugtrekkingsakkoord dat het recht heeft zijn verblijf na 31 december 2020 aan te vangen, heeft op grond van artikel 18, eerste lid onder b, tweede alinea, van het terugtrekkingsakkoord het recht een aanvraag voor een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc in te dienen uiterlijk drie maanden na inreis. Deze termijn van drie maanden na inreis blijft ook gelden bij een inreis na 30 september 2021. Verder kan het familielid, dat na 31 december 2020 Nederland is ingereisd, sowieso tot en met 30 september 2021 een aanvraag om een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc indienen. De termijn van 3 maanden na inreis is dus niet aan de orde zolang de aanvraag uiterlijk op 30 september 2021 is ingediend.
Termijnoverschrijding
De Brexit heeft ingrijpende verblijfsrechtelijke en maatschappelijke gevolgen in het geval niet tijdig een nieuw verblijfsdocument wordt aangevraagd. Daarom wordt een aanvraag van een VK-onderdaan en zijn familielid, die vóór het einde van de overgangsperiode (31 december 2020) in Nederland verbleef en die na 30 september 2021 een aanvraag indient nog gedurende één jaar (tot 1 oktober 2022) uit oogpunt van evenredigheid inhoudelijk in behandeling genomen, ongeacht de reden van de te late indiening. De toets op de aanwezigheid van een verschoonbare reden voor de te late aanvraag blijft gedurende deze periode derhalve achterwege.
Als de VK-onderdaan (en zijn familielid) niet uiterlijk op 30 september 2021 een aanvraag heeft ingediend voor verlening van een verblijfsdocument (als bedoeld in paragraaf B13/2.1 Vc), heeft hij vanaf 1 oktober 2021 in Nederland geen rechtmatig verblijf meer op grond van het terugtrekkingsakkoord. Maar als de VK onderdaan (en zijn familielid) daarna vóór 1 oktober 2022 alsnog de aanvraag indient, verkrijgt de VK onderdaan (en het familielid) bij inwilliging van de aanvraag alsnog met terugwerkende kracht vanaf 1 oktober 2021 weer verblijfsrecht op grond van het terugtrekkingsakkoord.
Ook voor het familielid van de VK-onderdaan dat het recht heeft om zijn verblijf inNederland na 31 december 2020 aan te vangen en die zijn aanvraag niet tijdig indient geldt dat de aanvraag nog gedurende één jaar (tot 1 oktober 2022) in behandeling wordt genomen, ongeacht de reden van de te late indiening. Als het familielid van de VK-onderdaan niet binnen de uiterlijke aanvraagtermijn (als bedoeld in artikel 18, lid 1 onder b van het terugtrekkingsakkoord) een aanvraag heeft ingediend voor verlening van een verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc, heeft hij vanaf de eerste dag na verstrijken van de uiterlijke aanvraagtermijn geen rechtmatig verblijf meer op grond van het terugtrekkingsakkoord. Maar als het familielid van de VK-onderdaan daarna vóór 1 oktober 2022 alsnog de aanvraag indient, verkrijgt het familielid bij inwilliging van de aanvraag alsnog vanaf het moment van indiening van de aanvraag weer verblijfsrecht op grond van het terugtrekkingsakkoord als bedoeld in paragraaf B13/2.1 Vc.
Bij aanvragen ingediend na 30 september 2022 toetst de IND op grond van artikel 18, eerste lid onder d van het terugtrekkingsakkoord of er verschoonbare redenen aanwezig zijn waarom de aanvraag niet binnen de termijn is ingediend. De IND betrekt bij de beoordeling of sprake is van een verschoonbare termijnoverschrijding alle relevante feiten en omstandigheden. Pas als de IND concludeert dat de aanvraag verschoonbaar te laat is ingediend, wordt aan de voorwaarden van B13/2.1 Vc getoetst.
Beperking en arbeidsmarktaantekening
De IND verleent het verblijfsdocument onder verwijzing naar het terugtrekkingsakkoord. De tekst op het verblijfsdocument luidt: ‘Residence document Withdrawal Agreement’. De arbeidsmarktaantekening luidt: ‘Arbeid vrij toegestaan, TWV niet vereist. Een (meer dan aanvullend) beroep op algemene middelen kan gevolgen hebben voor uw verblijfsrecht’.
Ingangsdatum en geldigheidsduur van het verblijfsdocument
De IND verleent het verblijfsdocument als bedoeld in paragraaf B13/2.1 Vc met ingang van de dag waarop op de aanvraag is beslist. De IND verleent het verblijfsdocument voor de duur van 5 jaar.
2.4 Beëindiging van het verblijfsrecht
Afwezigheid uit Nederland langer dan 6 (of 12) maanden
De IND beëindigt, op grond van artikel 15, lid 2, terugtrekkingsakkoord, het verblijfsrecht als bedoeld in paragraaf B13/2.1 Vc als (het familielid van) de VK-onderdaan:
op of na 1 oktober 2023 niet in Nederland verblijft en die afwezigheid uit Nederland meer dan zes maanden per jaar bedraagt; of
op of na 1 april 2024 niet in Nederland verblijft, als die afwezigheid uit Nederland verband houdt met belangrijke redenen zoals zwangerschap en bevalling, ernstige ziekte, studie of beroepsopleiding en langer dan twaalf achtereenvolgende maanden bedraagt.
Rechtsmisbruik of verstrekking onjuiste gegevens
De IND beëindigt het verblijfsrecht als bedoeld in paragraaf B13/2.1 Vc met terugwerkende kracht bij rechtsmisbruik of indien er onjuiste gegevens zijn verstrekt terwijl bekendheid met de juiste gegevens zou hebben geleid tot weigering van het verblijfsdocument (zie paragraaf B10/2.8.5 Vc).
Openbare orde en openbare veiligheid
De IND beëindigt het verblijfsrecht van de VK-onderdaan en zijn familielid als de VK-onderdaan of het familielid een gevaar voor de openbare orde vormt als bedoeld in artikel 20 van het terugtrekkingsakkoord.
Indien na de verlening van de verblijfsvergunning als bedoeld in paragraaf B13/2.1 Vc, maar vóór het einde van de overgangsperiode, nieuwe omstandigheden op het gebied van openbare orde zich voordoen op grond waarvan het verblijfsrecht kan worden ingetrokken, zijn de bepalingen van hoofdstuk 6 van richtlijn 2004/38/EG van toepassing. Bij openbare orde is de pleegdatum leidend. Indien het misdrijf is gepleegd vóór of op 31 december 2020 geldt het openbare orde criterium als bedoeld in paragraaf B10/2.8.6 Vc. Als het misdrijf ná 31 december 2020 is gepleegd geldt het openbare orde criterium als bedoeld in paragraaf B1/6 Vc.
Beroep op de algemene middelen
Als een economisch niet-actieve VK-onderdaan of zijn familielid een beroep doet op de algemene middelen, is ten aanzien van de beoordeling van de verblijfsrechtelijke gevolgen de inhoud van het onderdeel ‘Beroep op de algemene middelen’ van paragraaf B10/2.8.1 Vc van toepassing.
Daar waar in het onderdeel ‘beroep op de algemene middelen’ van paragraaf B10/2.8.1 sprake is van de term ‘verblijf’, betrekt de IND bij het beoordelen van de duur van het verblijf van de VK-onderdaan in Nederland zowel het (ononderbroken) verblijf van voor als van na de einddatum van de overgangsperiode.
Verbreking familierechtelijke relatie
Het verblijfsrecht (als bedoeld in paragraaf B13/2.1 Vc) van een familielid van een VK-onderdaan eindigt als niet langer sprake is van een familierechtelijke relatie als bedoeld in B13/1 Vc (onderdeel ‘Familieleden van VK-onderdanen’). Tenzij sprake is van een omstandigheid als bedoeld in artikel 12, 13 of 14 van Richtlijn 2004/38/EG (in het Vb geïmplementeerd in artikel 8.15, lid 2 tot en met 5) en aan de in die artikelen vermelde voorwaarden wordt voldaan. Daar waar in die artikelen ‘burger van de Unie’ staat vermeld dient dat in dit geval te worden gelezen als ‘VK-onderdaan’.
