4.1 Cross-border document
The valid document for crossing the border must have been issued by the competent authorities of a state recognised by the Netherlands. An exception to this rule is Taiwan. Taiwan is not recognised as a state by the Netherlands, whereas the travel document of Taiwan is recognised as a valid document for crossing the border. The valid document for crossing the border must be provided with a well-resembling passport photograph of the holder and must be signed by the holder.
The valid border crossing document must in any case contain the surname, the first name or first names, the nationality, the place of birth and the date of birth of the holder. In Article 6, paragraph 1, point (a), of the SGC, the criteria are listed which a border crossing document of a third-country national who intends a short stay must meet.
4.2 Issuance of special transit permits at the border
The official charged with border control shall, with a view to the short stay of the foreign national, issue a special entry permit (see Model M6) to a foreign national who:
is not subject to a visa requirement;
who, upon entry, does not possess a valid document for crossing the border.
A special entry permit is, after issuance, a valid document for crossing the border.
The issuance of special entry permits at the border is a competence of the Benelux Member States. The official charged with border control issues the special entry permit on the basis of the purpose of travel and the place of destination for:
the three Benelux Member States jointly;
two of the Member States;
one of the Member States.
The official in charge of border control shall assess the issuance of a special entry permit against each of the following conditions:
the foreign national demonstrates that there is a situation of force majeure;
the foreign national demonstrates that there exists an urgent and well-founded reason for the granting of access;
the foreign national makes it plausible that the duration of the stay will not exceed two weeks; and
the foreign national is in possession of a document establishing his identity.
Ad a.
The official charged with border control shall, in any event, understand a situation of force majeure to include:
seafaring passengers whose seagoing vessel has set sail unannounced;
persons overboard;
persons who have become victims of theft of the valid document for border crossing.
Ad d.
The document establishing the identity of the foreign national shall preferably be an identity document provided with a passport photograph issued by an authority of the country of origin of the foreign national. The official charged with border control shall affix a photograph of the foreign national to the special entry permit if the foreign national possesses a document establishing his identity, but that document is not provided with a photograph.
The official charged with border control shall issue the special border crossing permit to the foreign national free of charge.
4.3 Visa
The foreign national who petitions for entry into the Netherlands must, upon entry into the Netherlands, provide information to the official charged with border control in support of his petition for entry. The information provided by the foreign national to the official charged with border control must correspond with the information provided by the foreign national to the diplomatic mission for the purpose of obtaining a visa.
The foreign national must, in cases where this is required, possess an mvv for a stay of longer than 90 days.
4.4 Reisdoel
The foreign national shall make the purpose and duration of the intended stay plausible to the official charged with border control. The foreign national must, in support thereof, provide all information and present available means of evidence to the official charged with border control. A non-exhaustive list of means of evidence is included in Annex 1 to the SGC.
The official in charge of border control shall, with the consent of the foreign national, obtain information from the information point made available for this purpose by the relevant airline in the event that the foreign national has used electronic ticketing and for that reason is not in possession of a return ticket. The official in charge of border control shall point out to the foreign national that entry shall be refused if:
the foreign national does not grant permission to the official charged with border control to request the aforementioned information from the airline concerned; and
the foreign national does not otherwise make the purpose and the duration of the intended stay plausible.
The officer in charge of border control shall not refuse entry to a foreign national on the sole ground that the country of main destination stated at the border is not in accordance with the country that issued the visa based on its original purpose of travel. At the request of the officer in charge of border control, the foreign national must nevertheless make the stated purpose and duration of the stay plausible. The officer in charge of border control must verify the statements of the foreign national, unless it is immediately clear that the information provided by the foreign national is inconsistent or does not correspond with other (reliable) data obtained by the officer in charge of border control through other means. The officer in charge of border control shall, in any event, verify the facts and statements underlying the issuance of the visa. The officer in charge of border control shall, in principle, contact the competent authority that issued the visa regarding this matter and/or consult EUVIS.
The official in charge of border control shall confront the foreign national with discrepant information and shall enable the foreign national to provide an explanation therefor. The official in charge of border control shall refuse the foreign national entry and shall annul the visa if the official in charge of border control:
considers the statement of the foreign national to be insufficiently plausible;
finds that the foreign national has obtained the visa in an unlawful manner.
4.5 Means of support
The foreign national must have sufficient means of support for a stay of at most 90 days.
The means of support must, notwithstanding the provisions of paragraph B1/4.3.2 of the Aliens Circular (Vreemdelingencirculaire), be sufficient for the foreign national to provide for both the costs of the stay in the Netherlands and the costs of the journey to a place outside the Netherlands where entry is guaranteed. The official charged with border control must, in any event, weigh the following circumstances of the foreign national:
the duration of the intended stay;
the purpose of the journey;
the personal circumstances; and
the nature of the means of transport used.
A foreign national who travels independently must be able to provide for the costs of their stay and accommodation. For the Netherlands, an amount of at least € 55 per person per day applies. The amount of € 55 is exclusive of any costs for a flight to a place outside the Netherlands where the entry of the foreign national is guaranteed. The IND applies this amount as a guideline and takes into account the circumstances mentioned above.
The official charged with border control shall, under certain conditions, grant access to a foreign national whose ability to possess sufficient means of subsistence for the duration of the intended stay and/or for the return journey/journey to a third country is not certain. The official charged with border control shall grant access if the following conditions are met:
there is no reason to refuse the alien entry on the basis of one of the other conditions referred to in Article 6, paragraph 1, of the SBC;
the official charged with border control has no reasons to assume that the foreign national will not comply with the conditions for short stay as set forth in Article 12 of the Aliens Act (Vreemdelingenwet) (see free period A1/6 Aliens Circular (Vreemdelingencirculaire));
the foreign national shall, at the request of the official charged with border supervision, provide security for the costs of the journey to a place outside the Netherlands where their admission is guaranteed, by depositing a return ticket or a guarantee sum;
the foreign national shall, at the request of the official charged with border control, provide security by means of a solvent third party residing in the Netherlands acting as a guarantor by signing a declaration of guarantee.
The official charged with border control is authorised to impose a reporting obligation on the foreign national with the application of Article 4.24, first paragraph, under d, of the Aliens Decree (Vreemdelingenbesluit).
The official charged with border control shall inform the Chief of Police (Korpschef) regarding the granting of access under conditions by means of form M20.
A foreign national has a right of residence by operation of law during the free period if the foreign national meets the conditions set forth in Article 12 of the Aliens Act (Vw) and continues to meet those conditions. The free period amounts to 90 days.
In the context of a stay during the free period, the foreign national may demonstrate that he possesses sufficient means of support from income derived from activities to be performed or services to be rendered in this country. For certain employees, a work permit is required; in this regard, see B5 Vc. The duration of the activities to be performed or services to be rendered may not exceed the duration of the free period.
The official charged with the supervision of foreign nationals may request the foreign national to provide security if the official charged with border control did not do so upon the entry of the foreign national.
4.6 Deposit of return ticket and security deposit
The official charged with border control may request the foreign national to deposit a return ticket in his possession as security. In the event that the foreign national has made use of electronic ticketing and is therefore not in possession of a return ticket, the official charged with border control shall point out to the foreign national the possibility of having a return ticket printed by the airline. The official charged with border control shall request the foreign national to provide security if the airline concerned cannot or will not print the return ticket. The period of validity of the return ticket must be longer than the duration of the intended stay of the foreign national.
The foreign national may also deposit a guarantee sum instead of a return ticket. For the amount of the guarantee sum, the scheduled flight rates of KLM are decisive. For the rates, see www.klm.com.
The foreign national may in any event make use of the possibility to deposit a guarantee sum in the following situations:
the foreign national is traveling to the Netherlands for a family visit or for tourist purposes and is not in possession of a return ticket;
the foreign national is a seafarer who, after entry or signing off in the Netherlands, is granted permission to seek employment on board another seagoing vessel (see A1/8 Vc).
Management of return ticket and guarantee sum
The official charged with border control shall issue a leaflet to the foreign national who, upon entry into the Netherlands, deposits a guarantee sum or a return ticket. This leaflet shall provide information regarding the receipt, management, and return of guarantee sums and return tickets deposited at the border.
The officer in charge of border control shall issue a receipt to the foreign national who deposits a return ticket or a guarantee sum. The officer in charge of border control shall also issue a receipt to a third party who deposits a guarantee sum.
The Korpschef shall manage the return tickets and security deposits deposited with him. Return tickets deposited at the border shall be forwarded by the official charged with border control to the Korpschef of the police region in which the municipality where the foreign national will reside is located. Security deposits deposited at the border shall be paid by the official charged with border control into the account of the Korpschef. Return tickets and security deposits deposited at the border crossing points of Amsterdam Schiphol (airport), Rotterdam and Rotterdam-Havens shall remain with the KMar and ZHP.
The public authority managing the security deposits shall not pay interest on deposited security deposits.
Restitution in the Netherlands
The foreign national who has deposited a return ticket or a guarantee sum must apply directly to the government authority managing the guarantee sums for the return thereof. The same applies to third parties who have deposited a guarantee sum for the benefit of a foreign national.
The government authority managing the guarantee deposits shall return the guarantee deposit or the return ticket to the foreign national or the third party upon presentation of the receipt, provided that at least one of the following conditions is met:
there is sufficient certainty regarding the departure of the foreign national at their own expense;
the foreign national has been granted a residence permit.
The government authority managing the guarantee deposits shall return the guarantee deposit deposited by a third party upon presentation of the receipt after the departure of the foreign national from the Schengen area.
The government authority managing the guarantee deposits shall, upon the return of the guarantee deposit or the return ticket to the foreign national or the third party, collect the receipt.
Restitution from abroad
A foreign national who has left the Netherlands without requesting the return of the guarantee deposit or the return ticket must apply to a Dutch diplomatic or consular representation established in his country with a petition for the return of the guarantee deposit or the return ticket. The government authority managing the guarantee deposits must refer a foreign national who submits a petition for the return of the guarantee deposit directly from abroad to the Dutch diplomatic or consular representation in his country of origin or his country of habitual residence.
4.7 Guarantee by a third party
In the event that the foreign national does not personally possess sufficient means of subsistence, the official charged with border surveillance shall grant the foreign national access when a solvent third party who has lawful residence in the Netherlands acts as a guarantor by signing a guarantee declaration (see Annex 6a VV up to and including Annex 6c VV/Article 14, fourth paragraph, Visa Code).
The solvent third party shall act as a guarantor for the costs that may arise for the State or for other public bodies from the stay of the foreign national, as well as for the costs of travel to a place outside the Netherlands where the admission of the foreign national is guaranteed. The official charged with border control shall designate a third party as solvent if the third party independently and sustainably possesses sufficient means of support. The concepts of independent, sustainable, and sufficient are further elaborated in Article 3.73 Vb, Article 3.75 Vb, and Article 3.74, paragraph 1, under (a) Vb and are applicable accordingly to the granting of a short-stay visa to a foreign national.
In the event that a solvent third party provides a guarantee for more than one person, the official charged with border control may impose additional conditions. The official charged with border control may require that the solvent third party submits a bank guarantee in the amount of the KLM scheduled flight fare and/or several separate guarantee statements. The solvent third party must independently and sustainably possess sufficient means of support for each additionally proposed foreign national for whom the solvent third party wishes to provide a guarantee.
The Minister of Foreign Affairs or the official charged with border control may refuse an application for a short-stay visa if a solvent third party has previously acted as a guarantor for a foreign national who applied for a visa, and he does not demonstrate, or demonstrates insufficiently, that this foreign national returned in a timely manner to the country of origin or to a country where the admission of the foreign national is guaranteed.
4.8 Establishment of Dutch nationality
The official in charge of border control is authorised to require a person who claims to be a Dutch national, on the basis of Article 4.7 of the Aliens Decree (Vreemdelingenbesluit), to demonstrate the plausibility of their Dutch nationality. The official in charge of border control shall contact the municipality where the person claims to be registered with an address in the Personal Records Database (Basisregistratie Personen), in order to establish the nationality.
The official in charge of border control shall assume Dutch nationality on the basis of the Rwn (Stb. 1984, 628) or the Agreement on the Assignment of Nationality between the Netherlands and Suriname and in any case on the basis of the following documents:
a valid Dutch document for border crossing;
a Dutch laissez-passer in which the Dutch nationality is stated;
a recent proof of Dutch nationality;
a proof of naturalisation as a Dutch citizen;
a declaration to acquire Netherlands nationality.
A foreign national to whom the Act of 9 September 1976 (Stb. 468) concerning the position of Moluccans applies, shall be treated as a Dutchman and is not a foreign national within the meaning of the Vw (see also Article 1 Vw).
For the acquisition of treatment as a Dutch national and a description of the means of evidence by which Moluccans must demonstrate treatment as a Dutch national, reference is made to the Manual for the application of the RWN.
4.9 Procedure lapsed and withholding of document for border crossing
The Passport Implementation Regulation Royal Netherlands Marechaussee (Paspoortuitvoeringsregeling Koninklijke Marechaussee) of 7 September 2001 establishes the cases in which a document for the crossing of borders by Dutch nationals shall be declared lapsed or shall be impounded.
4.10 Nationals of the EU, the EEA and Switzerland
The visa-required foreign national must, in order to qualify for the application of the more favourable rules regarding the application for and issuance of visas, demonstrate with evidence that he:
is a family or household member of a national of the EU, the EEA or Switzerland within the meaning of Article 8.7, paragraphs 2 and 3, of the Aliens Decree (Vreemdelingenbesluit);
is an unmarried partner (not being a registered partner) of a national of the EU, the EEA and Switzerland and has a sustainable relationship with that national, within the meaning of Article 8.7, fourth paragraph, of the Aliens Decree (Vreemdelingenbesluit).
If the foreign national cannot convincingly demonstrate that he belongs to the aforementioned categories, the regular visa policy shall apply.
The official charged with border control assesses whether a durable relationship exists in accordance with the provisions of paragraph B10/2.2.4.5 Vc.
For the evidence that there is a lasting relationship, reference is made to paragraph B10/2.7.3 Vc.
In all cases, it must concern an existing lasting relationship.
Where the foreign national has convincingly demonstrated that the applicant is a family member or a household member within the meaning of Article 8.7, second, third or fourth paragraph of the Aliens Decree (Vreemdelingenbesluit), the official charged with border control may refuse the issuance of a visa exclusively:
on the grounds mentioned in Article 8.8, paragraph 1 under a and b, Vb;
if there is an abuse of right or fraud such as a sham marriage (schijnhuwelijk).
The grounds mentioned in Article 8.8, paragraph 1, of the Aliens Decree (Vreemdelingenbesluit) shall be interpreted as follows.
Article 8.8, paragraph 1, opening words and under a Vb
The officer in charge of border control shall base the assessment exclusively on the personal conduct of the foreign national. The officer in charge of border control must observe the principle of proportionality (Article 3:4 of the General Administrative Law Act). Criminal convictions in themselves do not constitute sufficient grounds to refuse entry to the foreign national. A threat to public policy, national security, or public health exists in any event in the following situations:
the foreign national is flagged in the E&S as an ‘undesirable foreign national’ or ‘declared undesirable pursuant to Article 67 of the Aliens Act (Vreemdelingenwet)’;
the foreign national is in possession of prohibited weapons;
the foreign national is in possession of controlled substances; or
the foreign national is suspected of human trafficking.
The official charged with border control must also in that case determine, on the basis of the personal conduct of the foreign national, that there is an actual, genuine, and serious threat to a fundamental interest of society.
Article 8.8, paragraph 1, opening words and under b of the Aliens Decree (Vreemdelingenbesluit)
This concerns potentially epidemic diseases as defined in the publications of the World Health Organization, and other infectious diseases or contagious parasitic diseases, insofar as protective measures have been adopted in the Netherlands with respect to its own nationals. The latest developments regarding infectious diseases are maintained on www.rijksoverheid.nl.
Article 8.8, paragraph 1, opening words and under c of the Aliens Decree (Vreemdelingenbesluit)
The foreign national must, at the time of the previous removal for reasons of public order, national security or public health, have been identified as a current, real and serious threat to public order, national security or public health. The foreign national who has previously been removed for reasons of public order, national security or public health may, after the lapse of a reasonable period, and in any event after three years calculated from his departure, submit an application for the revocation of the previous decision to remove him from the Netherlands.
In the event that the foreign national has been declared undesirable, the foreign national must submit an application for the lifting of the declaration of undesirability. During the processing of this application, the foreign national has no right of entry to the Netherlands.
The official charged with border control shall issue the visa free of charge in the event that he encounters a family member as referred to in Article 8.7, second, third or fourth paragraph, of the Aliens Decree (Vreemdelingenbesluit) at the border and he requests the foreign national to apply for a visa in order to accompany or join the national of the EU, the EEA or Switzerland.
The official in charge of border control shall refuse entry to the foreign national on the basis of Article 3, first paragraph, under (d), of the Aliens Act (Vreemdelingenwet) in conjunction with Article 8.8 of the Aliens Decree (Vreemdelingenbesluit) and shall use model M18 for this purpose. The reasoning in model M18 must be concrete. The official in charge of border control may not suffice with the mere notification that the foreign national poses a threat to public order, national security, or public health. Upon notification of the refusal of entry, the official in charge of border control must state that an administrative appeal may be lodged against it with the IND within four weeks. The foreign national may not await the processing of the administrative appeal in the Netherlands. The foreign national must leave the Netherlands immediately on the basis of Article 5, first paragraph, of the Aliens Act, unless there is an initial petition for a provisional remedy. The official in charge of border control must affix an (entry) refusal stamp to the valid document for border crossing of nationals of the EU, the EEA, and Switzerland and of their family members.
4.11 Diplomatic and consular couriers
Diplomatic and consular couriers are:
professional couriers;
designated as such for a single voyage.
The foreign nationals must be in possession of an official document indicating their special status and the number of packages constituting the diplomatic or consular bag.
The packages must bear visible external marks of their character. The courier shall enjoy personal inviolability. The official charged with border control may not apply the coercive measures referred to in Article 50, paragraphs 2, 3, 4 and 5 of the Aliens Act (Vreemdelingenwet). The official charged with border control may not open or detain the diplomatic or consular bag.
4.12 Seafarers travelling as passengers
A seafarer who wishes to go ashore must present an identity document for inspection to the official charged with border control. A valid document for crossing the border shall be sufficient in that case.
The head of the border crossing point makes an annotation on the crew list next to the name of the seafarer when a seafarer does not or no longer meets the conditions for shore leave laid down in the SGC. The head of the border crossing point may, in the event of a threat to public order, national security or public health, transfer the seafarer to the aliens police pursuant to Article 50 Vw. The head of the border crossing point shall in any event transfer the seafarer there in the following situations:
the seaman is flagged as an undesirable alien or as an alien declared undesirable on the basis of Article 67 of the Aliens Act (Vreemdelingenwet), or an entry ban has been imposed;
the seaman has remained behind after the departure of the seagoing vessel, or has been signed off, without complying with the conditions for entry and stay in the Netherlands.
The official in charge of border control is not required to request an authorisation for the granting of a visa to a seaman who wishes to have access to places other than the municipality in which the port where his seagoing vessel is moored is situated or the municipalities adjacent thereto.
4.13 Adopted child, adoptive child and foster child
A foreign national who wishes to enter the Netherlands for residence with the purpose of 'adopted child' (adoptiekind), 'adoptive child' (adoptiefkind) or 'foster child' (pleegkind) must be in possession of a valid document for border crossing. This valid document for border crossing is a valid passport provided with a valid provisional residence permit (machtiging tot voorlopig verblijf) if such is required.
The officer charged with border control shall grant entry to a foreign national to whom an mvv has been issued as an adopted child, an adoptive child, or a foster child. The officer charged with border control must consult the IND if no mvv for residence as an adopted child, an adoptive child, or a foster child has been granted.
The IND shall grant permission for entry exclusively in the following situations:
the foreign national is an adopted child, or a child to be adopted for whom the prospective adoptive parents or adoptive parents can submit a document demonstrating that the authorities of the country of origin consent to the placement of the child in the family of the prospective adoptive parents or adoptive parents in the Netherlands;
there are compelling reasons of a humanitarian nature.
In both cases, the official charged with border control shall impose a reporting obligation on the foreign national as referred to in Article 4.26 of the Aliens Decree (Vreemdelingenbesluit).
The official in charge of border control shall, in the event of compelling reasons of a humanitarian nature, require the prospective foster parents to sign a guarantee statement (garantverklaring) (see Annex 6c VV). Prospective adoptive parents or adoptive parents are not required to sign a guarantee statement.
4.1 Document voor grensoverschrijding
Het geldige document voor grensoverschrijding moet zijn afgegeven door de bevoegde autoriteiten van een door Nederland erkende staat. Een uitzondering op deze regel vormt Taiwan. Taiwan wordt niet door Nederland als staat erkend terwijl het reisdocument van Taiwan wel wordt erkend als geldig document voor grensoverschrijding. Het geldige document voor grensoverschrijding moet zijn voorzien van een goedgelijkende pasfoto van de houder en moet ondertekend zijn door de houder.
Het geldige document voor grensoverschrijding moet in ieder geval de familienaam, de voornaam of voornamen, de nationaliteit, de geboorteplaats en de geboortedatum van de houder bevatten. In artikel 6, eerste lid, onder a van de SGC staan de criteria genoemd waaraan een document voor grensoverschrijding moet voldoen van een onderdaan van een derde land die kort verblijf beoogt.
4.2 Afgifte van bijzondere doorlaatbewijzen aan de grens
De ambtenaar belast met de grensbewaking geeft met het oog op kort verblijf van de vreemdeling een bijzonder doorlaatbewijs (zie Model M6) af aan een vreemdeling die:
niet visumplichtig is;
die bij binnenkomst niet beschikt over een geldig document voor grensoverschrijding.
Een bijzonder doorlaatbewijs is na afgifte een geldig document voor grensoverschrijding.
Het afgeven van bijzondere doorlaatbewijzen aan de grens is een bevoegdheid van de lidstaten van de Benelux. De ambtenaar belast met de grensbewaking geeft het bijzondere doorlaatbewijs af op grond van het reisdoel en de plaats van bestemming voor:
de drie Beneluxlidstaten gezamenlijk;
twee van de lidstaten;
één van de lidstaten.
De ambtenaar belast met de grensbewaking toetst de afgifte van een bijzonder doorlaatbewijs aan elk van de volgende voorwaarden:
de vreemdeling toont aan dat er sprake is van overmacht;
de vreemdeling toont aan dat er een dringende en gegronde reden voor verlening van toegang bestaat;
de vreemdeling maakt aannemelijk dat de duur van het verblijf niet langer dan twee weken zal bedragen; en
de vreemdeling is in het bezit van een document waaruit zijn identiteit blijkt.
Ad a.
De ambtenaar belast met de grensbewaking verstaat onder een situatie van overmacht in ieder geval:
passagierende zeelieden van wie het zeeschip onaangekondigd is uitgevaren;
drenkelingen;
personen die het slachtoffer zijn geworden van diefstal van het geldige document voor grensoverschrijding.
Ad d.
Het document waaruit de identiteit van de vreemdeling blijkt is bij voorkeur een identiteitsbewijs voorzien van een pasfoto afgegeven door een autoriteit van het land van herkomst van de vreemdeling. De ambtenaar belast met de grensbewaking bevestigt op het bijzonder doorlaatbewijs een foto van de vreemdeling als de vreemdeling beschikt over een document waaruit zijn identiteit blijkt, maar dat document niet is voorzien van een foto.
De ambtenaar belast met de grensbewaking verleent het bijzondere doorlaatbewijs gratis aan de vreemdeling.
4.3 Visum
De vreemdeling die verzoekt om toegang tot Nederland moet bij binnenkomst in Nederland informatie verstrekken aan de ambtenaar belast met de grensbewaking ter ondersteuning van zijn verzoek om toegang. De informatie die de vreemdeling aan de ambtenaar belast met de grensbewaking verstrekt moet overeenkomen met de informatie die de vreemdeling heeft verstrekt aan de diplomatieke post ter verkrijging van een visum.
De vreemdeling moet, in de gevallen waarin dat vereist is, voor een verblijf van langer dan 90 dagen beschikken over een mvv.
4.4 Reisdoel
De vreemdeling maakt het doel en duur van het voorgenomen verblijf aannemelijk bij de ambtenaar belast met de grensbewaking. De vreemdeling moet ter onderbouwing alle gegevens verstrekken en beschikbare bewijsmiddelen tonen aan de ambtenaar belast met de grensbewaking. In bijlage 1 bij de SGC is een niet-uitputtende lijst van bewijsmiddelen opgenomen.
De ambtenaar belast met de grensbewaking wint met toestemming van de vreemdeling inlichtingen in bij het hiervoor door de betreffende luchtvaartmaatschappij beschikbaar gestelde informatiepunt in het geval de vreemdeling gebruik heeft gemaakt van electronic ticketing en om die reden niet in het bezit is van een retourticket. De ambtenaar belast met de grensbewaking wijst de vreemdeling er op dat de toegang wordt geweigerd als:
de vreemdeling geen toestemming verleent aan de ambtenaar belast met de grensbewaking om de bovenbedoelde informatie op te vragen bij de betreffende luchtvaartmaatschappij; en
de vreemdeling niet op andere wijze het doel en de duur van het voorgenomen verblijf aannemelijk maakt.
De ambtenaar belast met de grensbewaking weigert niet de toegang aan een vreemdeling op grond van het enkele feit dat het aan de grens opgegeven land van hoofdreisdoel niet in overeenstemming is met het land dat vanwege zijn oorspronkelijke reisdoel het visum had afgegeven. De vreemdeling moet op vordering van de ambtenaar belast met de grensbewaking het door hem opgegeven doel en de duur van het verblijf alsnog aannemelijk maken. De ambtenaar belast met de grensbewaking moet de verklaringen van de vreemdeling controleren, tenzij onmiddellijk duidelijk is dat de door de vreemdeling verstrekte informatie niet consistent is of niet overeenkomt met andere (betrouwbare) gegevens die de ambtenaar belast met de grensbewaking langs andere weg heeft verkregen. De ambtenaar belast met de grensbewaking controleert in ieder geval feiten en verklaringen die ten grondslag liggen aan de afgifte van het visum. De ambtenaar belast met de grensbewaking neemt in beginsel daarover contact op met de bevoegde autoriteit die het visum heeft afgegeven en/of raadpleegt EUVIS.
De ambtenaar belast met de grensbewaking confronteert de vreemdeling met afwijkende informatie en stelt de vreemdeling in staat hier een verklaring voor te geven. De ambtenaar belast met de grensbewaking weigert de vreemdeling de toegang en verklaart het visum nietig, als de ambtenaar belast met de grensbewaking:
de verklaring van de vreemdeling onvoldoende aannemelijk acht;
constateert dat de vreemdeling het visum op onrechtmatige wijze heeft verkregen.
4.5 Middelen van bestaan
De vreemdeling moet voor een verblijf van ten hoogste 90 dagen beschikken over voldoende middelen van bestaan.
De middelen van bestaan moeten, anders dan bepaald in paragraaf B1/4.3.2 Vc, voor de vreemdeling voldoende zijn om te voorzien in zowel de kosten van het verblijf in Nederland als in de kosten van de reis naar een plaats buiten Nederland waar de toegang gewaarborgd is. De ambtenaar belast met de grensbewaking moet in ieder geval de volgende omstandigheden van de vreemdeling meewegen:
de duur van het voorgenomen verblijf;
het reisdoel;
de persoonlijke omstandigheden; en
de aard van het gebruikte vervoermiddel.
Een vreemdeling die zelfstandig reist, moet in staat zijn te voorzien in de kosten van zijn verblijf en onderdak. Voor Nederland geldt een bedrag van ten minste € 55 per persoon per dag. Het bedrag van € 55 is exclusief de eventuele kosten voor een vliegreis naar een plaats buiten Nederland waar de toegang van de vreemdeling is gewaarborgd. De IND hanteert dit bedrag als richtsnoer en betrekt daarbij de hierboven genoemde omstandigheden.
De ambtenaar belast met de grensbewaking verleent onder voorwaarden toegang aan een vreemdeling van wie niet zeker is dat hij in staat is over voldoende middelen van bestaan te beschikken voor de duur van het voorgenomen verblijf en/of voor de terugreis/reis naar een derde land. De ambtenaar belast met de grensbewaking verleent de toegang als voldaan is aan de volgende voorwaarden:
er bestaat geen aanleiding de vreemdeling de toegang om een van de andere voorwaarden genoemd in artikel 6, eerste lid, SGC te weigeren;
de ambtenaar belast met de grensbewaking heeft geen redenen om aan te nemen dat de vreemdeling zich niet zal houden aan de in artikel 12 Vw gestelde voorwaarden voor kort verblijf (zie vrije termijn A1/6 Vc);
de vreemdeling stelt op verzoek van de ambtenaar belast met de grensbewaking zekerheid voor de kosten van de reis naar een plaats buiten Nederland waar zijn toelating gewaarborgd is, door het deponeren van een retourticket of een garantiesom;
de vreemdeling stelt op verzoek van de ambtenaar belast met de grensbewaking zekerheid doordat een in Nederland wonende solvabele derde zich garant stelt door ondertekening van een garantverklaring.
De ambtenaar belast met de grensbewaking is bevoegd de vreemdeling een meldplicht op te leggen met toepassing van artikel 4.24, eerste lid, onder d, Vb.
De ambtenaar belast met de grensbewaking informeert de Korpschef over de toegangsverlening onder voorwaarden door middel van model M20.
Een vreemdeling heeft van rechtswege verblijf in de vrije termijn als de vreemdeling voldoet aan de in artikel 12 Vw gestelde voorwaarden en aan die voorwaarden blijft voldoen. De vrije termijn bedraagt 90 dagen.
De vreemdeling mag in het kader van verblijf in de vrije termijn aantonen dat hij voldoende middelen van bestaan heeft uit inkomsten uit hier te lande te verrichten werkzaamheden of te verlenen diensten. Voor bepaalde werknemers is een tewerkstellingsvergunning vereist, zie hiervoor B5 Vc. De duur van de te verrichten werkzaamheden of diensten mag niet langer zijn dan de duur van de vrije termijn.
De ambtenaar belast met het toezicht op vreemdelingen mag aan de vreemdeling vragen om zekerheid te stellen als de ambtenaar belast met de grensbewaking dat bij binnenkomst van de vreemdeling niet heeft gedaan.
4.6 Deponeren retourticket en garantiesom
De ambtenaar belast met de grensbewaking mag aan de vreemdeling verzoeken een in zijn bezit zijnd retourticket te deponeren tot zekerheidstelling. In het geval de vreemdeling gebruik heeft gemaakt van electronic ticketing en daarom niet in het bezit is van een retourticket, wijst de ambtenaar belast met de grensbewaking de vreemdeling op de mogelijkheid om alsnog door de luchtvaartmaatschappij een retourticket te laten printen. De ambtenaar belast met de grensbewaking verzoekt de vreemdeling zekerheid te stellen als de betreffende luchtvaartmaatschappij het retourticket niet kan of wil printen. De geldigheidsduur van het retourticket moet langer zijn dan de duur van het voorgenomen verblijf van de vreemdeling.
De vreemdeling mag ook een garantiesom deponeren in plaats van een retourticket. Voor de hoogte van de garantiesom zijn de lijnvluchttarieven van de KLM bepalend. Zie voor de tarieven www.klm.com.
De vreemdeling mag in ieder geval in de volgende situaties gebruik maken van de mogelijkheid een garantiesom te deponeren:
de vreemdeling komt voor familiebezoek of toeristische doeleinden naar Nederland en is niet in het bezit van een retourticket;
de vreemdeling is een zeeman die na binnenkomst of afmonstering in Nederland toestemming krijgt voor het zoeken van werk aan boord van een ander zeeschip (zie A1/8 Vc).
Beheer retourticket en garantiesom
De ambtenaar belast met de grensbewaking reikt aan de vreemdeling die bij binnenkomst in Nederland een garantiesom of een retourticket deponeert een folder uit. In deze folder wordt informatie verschaft over ontvangst, beheer en teruggave van aan de grens gedeponeerde garantiesommen en retourtickets.
De ambtenaar belast met de grensbewaking geeft aan de vreemdeling die een retourticket of een garantiesom deponeert een ontvangstbewijs af. De ambtenaar belast met de grensbewaking geeft ook aan een derde die een garantiesom deponeert een ontvangstbewijs af.
De Korpschef beheert de bij hem gedeponeerde retourtickets en garantiesommen. Retourtickets die aan de grens zijn gedeponeerd, zendt de ambtenaar belast met de grensbewaking toe aan de Korpschef van de politieregio waarin de gemeente waar de vreemdeling zal verblijven is gelegen. Garantiesommen die aan de grens zijn gedeponeerd stort de ambtenaar belast met de grensbewaking op de rekening van de Korpschef. Retourtickets en garantiesommen die aan de grensdoorlaatposten van Amsterdam Schiphol (luchthaven), Rotterdam en Rotterdam-Havens zijn gedeponeerd blijven bij de KMar en ZHP.
De overheidsinstantie die de garantiesommen beheert, vergoedt geen rente over gedeponeerde garantiesommen.
Teruggave in Nederland
De vreemdeling die een retourticket of een garantiesom heeft gedeponeerd, moet zich voor teruggave daarvan rechtstreeks wenden tot de overheidsinstantie die de garantiesommen beheert. Hetzelfde geldt voor derden die een garantiesom ten behoeve van een vreemdeling hebben gedeponeerd.
De overheidsinstantie die de garantiesommen beheert, geeft de garantiesom of het retourticket terug aan de vreemdeling of de derde op vertoon van het ontvangstbewijs als tenminste aan één van de volgende voorwaarden is voldaan:
er bestaat voldoende zekerheid over het vertrek van de vreemdeling op eigen kosten;
de vreemdeling is in het bezit gesteld van een verblijfsvergunning.
De overheidsinstantie die de garantiesommen beheert, geeft de garantiesom gedeponeerd door een derde op vertoon van het ontvangstbewijs terug na vertrek van de vreemdeling uit het Schengengebied.
De overheidsinstantie die de garantiesommen beheert, neemt bij teruggave van de garantiesom of het retourticket aan de vreemdeling of de derde het ontvangstbewijs in.
Teruggave vanuit het buitenland
Een vreemdeling die Nederland heeft verlaten zonder te verzoeken om teruggave van de garantiesom of het retourticket, moet zich tot een in zijn land gevestigde Nederlandse diplomatieke of consulaire vertegenwoordiging wenden met het verzoek om teruggave van de garantiesom of het retourticket. De overheidsinstantie die de garantiesommen beheert moet een vreemdeling die rechtstreeks vanuit het buitenland een verzoek om teruggave van de garantiesom indient, verwijzen naar de Nederlandse diplomatieke of consulaire vertegenwoordiging in zijn land van herkomst of zijn land van bestendig verblijf.
4.7 Garantstelling door derde
In het geval dat de vreemdeling zelf niet over voldoende middelen van bestaan beschikt, verleent de ambtenaar belast met de grensbewaking de vreemdeling toegang wanneer een solvabele derde die in Nederland rechtmatig verblijf heeft zich garant stelt door ondertekening van een garantverklaring (zie bijlage 6a VV tot en met bijlage 6c VV/artikel 14, vierde lid, Visumcode).
De solvabele derde stelt zich garant voor de kosten die voor de staat of voor andere openbare lichamen uit het verblijf van de vreemdeling kunnen voortvloeien, en ook voor de kosten van de reis naar een plaats buiten Nederland waar de toelating van de vreemdeling is gewaarborgd. De ambtenaar belast met de grensbewaking merkt een derde aan als solvabel als de derde zelfstandig en duurzaam beschikt over voldoende middelen van bestaan. De begrippen zelfstandig, duurzaam en voldoende zijn nader uitgewerkt in artikel 3.73 Vb, artikel 3.75 Vb en artikel 3.74, eerste lid, onder a Vb en zijn overeenkomstig van toepassing op de verlening van een visum voor kort verblijf aan een vreemdeling.
In het geval dat een solvabele derde zich garant stelt voor meer dan één persoon, mag de ambtenaar belast met de grensbewaking aanvullende voorwaarden stellen. De ambtenaar belast met de grensbewaking mag verlangen dat de solvabele derde een bankgarantie ter hoogte van het lijnvluchttarief KLM en/of meerdere gescheiden garantverklaringen overlegt. De solvabele derde moet zelfstandig en duurzaam over voldoende middelen van bestaan beschikken voor elke aanvullend aangedragen vreemdeling voor wie de solvabele derde zich garant wil stellen.
De Minister van BuZa of de ambtenaar belast met de grensbewaking mag een aanvraag voor een visum kort verblijf afwijzen als een solvabele derde zich al eerder garant heeft gesteld voor een vreemdeling die een visum heeft aangevraagd en hij niet of onvoldoende aannemelijk maakt dat deze vreemdeling tijdig is teruggekeerd naar het land van herkomst of een land waar de toelating van de vreemdeling is gewaarborgd.
4.8 Aannemelijk maken Nederlanderschap
De ambtenaar belast met de grensbewaking is bevoegd een persoon die stelt Nederlander te zijn, te verplichten op grond van artikel 4.7 Vb om zijn Nederlanderschap aannemelijk te maken. De ambtenaar belast met de grensbewaking neemt contact op met de gemeente waar de persoon zegt te zijn ingeschreven met een adres in de BRP, om de nationaliteit vast te stellen.
De ambtenaar belast met de grensbewaking neemt de Nederlandse nationaliteit aan op grond van de Rwn (Stb. 1984, 628) of van de Toescheidingsovereenkomst Nederland-Suriname en in ieder geval op grond van de volgende documenten:
een geldig Nederlands document voor grensoverschrijding;
een Nederlands laissez-passer waarin de Nederlandse nationaliteit is vermeld;
een recent bewijs van Nederlanderschap;
een bewijs van naturalisatie tot Nederlander;
een kennisgeving tot verkrijging van het Nederlanderschap.
Een vreemdeling op wie de wet van 9 september 1976 (Stb. 468) betreffende de positie van Molukkers van toepassing is, wordt als Nederlander behandeld en is geen vreemdeling in de zin van de Vw (zie ook artikel 1 Vw).
Voor de verkrijging van een behandeling als Nederlander en een beschrijving van de bewijsmiddelen, waarmee Molukkers de behandeling als Nederlander moeten aantonen, wordt verwezen naar de Handleiding voor de toepassing van de Rwn.
4.9 Procedure vervallen en inhouding document voor grensoverschrijding
In de Paspoortuitvoeringsregeling Koninklijke Marechaussee van 7 september 2001 is vastgelegd in welke gevallen een document voor grensoverschrijding van Nederlanders vervallen wordt verklaard of wordt ingehouden.
4.10 Onderdanen van de EU, de EER en Zwitserland
De visumplichtige vreemdeling moet, om in aanmerking te komen voor de toepassing van de gunstigere regels met betrekking tot de aanvraag en afgifte van visa, met bewijsmiddelen aantonen dat hij:
een familie- of gezinslid is van een onderdaan van de EU, de EER of Zwitserland in de zin van artikel 8.7, tweede en derde lid, Vb;
een ongehuwde partner (niet zijnde een geregistreerde partner) is van een onderdaan van de EU, de EER en Zwitserland en een duurzame relatie met die onderdaan heeft, in de zin van artikel 8.7, vierde lid, Vb.
Als de vreemdeling niet overtuigend kan aantonen dat hij behoort tot de hiervoor genoemde categorieën, dan geldt het reguliere visumbeleid.
De ambtenaar belast met de grensbewaking toetst of er sprake is van een duurzame relatie volgens het gestelde in paragraaf B10/2.2.4.5 Vc.
Voor de bewijsmiddelen dat sprake is van een duurzame relatie wordt verwezen naar paragraaf B10/2.7.3 Vc.
In alle gevallen dient het om een bestaande duurzame relatie te gaan.
Wanneer de vreemdeling overtuigend heeft aangetoond dat de aanvrager een familie- of een gezinslid is in de zin van artikel 8.7, tweede, derde of vierde lid, Vb, mag de ambtenaar belast met de grensbewaking de afgifte van een visum uitsluitend weigeren:
op de gronden genoemd in artikel 8.8, eerste lid onder a en b, Vb;
als sprake is van rechtsmisbruik of fraude zoals schijnhuwelijk.
De gronden genoemd in artikel 8.8, eerste lid, Vb worden als volgt uitgelegd.
Artikel 8.8, eerste lid, aanhef en onder a Vb
De ambtenaar belast met de grensbewaking baseert de beoordeling uitsluitend op het persoonlijk gedrag van de vreemdeling. De ambtenaar belast met de grensbewaking moet het evenredigheidsbeginsel in acht nemen (artikel 3:4 Awb). Strafrechtelijke veroordelingen op zichzelf vormen onvoldoende grond om de vreemdeling toegang te weigeren. Van een bedreiging van de openbare orde, de nationale veiligheid of de volksgezondheid is in ieder geval sprake in de volgende situaties:
de vreemdeling staat in het E&S gesignaleerd als ‘ongewenst vreemdeling’ of ‘ongewenstverklaard ex artikel 67 Vw’;
de vreemdeling is in het bezit van verboden wapens;
de vreemdeling is in het bezit van verdovende middelen; of
de vreemdeling wordt verdacht van mensenhandel.
De ambtenaar belast met de grensbewaking moet ook in dat geval aan de hand van het persoonlijke gedrag van de vreemdeling vaststellen dat sprake is van een actuele, werkelijke en ernstige bedreiging voor een fundamenteel belang van de samenleving.
Artikel 8.8, eerste lid, aanhef en onder b Vb
Het gaat hier om potentieel epidemische ziekten zoals gedefinieerd in de publicaties van de Wereldgezondheidsorganisatie, en andere infectieziekten of besmettelijke parasitaire ziekten, voor zover in Nederland beschermende regelingen zijn getroffen ten aanzien van de eigen onderdanen. Op www.rijksoverheid.nl worden de laatste ontwikkelingen over infectieziekten bijgehouden.
Artikel 8.8, eerste lid, aanhef en onder c Vb
De vreemdeling moet bij de eerdere verwijdering om redenen van de openbare orde, de nationale veiligheid of de volksgezondheid aangemerkt zijn als een actuele, werkelijke en ernstige bedreiging van de openbare orde, de nationale veiligheid of de volksgezondheid. De vreemdeling die eerder om redenen van de openbare orde, de nationale veiligheid of de volksgezondheid is verwijderd mag na verloop van een redelijke termijn, en in ieder geval na drie jaar gerekend vanaf zijn vertrek, een aanvraag indienen om opheffing van het eerdere besluit om hem uit Nederland te verwijderen.
In het geval de vreemdeling ongewenst is verklaard moet de vreemdeling een aanvraag indienen tot opheffing van de ongewenstverklaring. Gedurende de behandeling van deze aanvraag heeft de vreemdeling geen recht van toegang tot Nederland.
De ambtenaar belast met de grensbewaking verstrekt het visum gratis in het geval dat hij een familie- of gezinslid als bedoeld in artikel 8.7, tweede, derde of vierde lid, Vb aan de grens aantreft en hij de vreemdeling verzoekt om een visum aan te vragen om de onderdaan van de EU, de EER en Zwitserland te begeleiden of zich bij die onderdaan te voegen.
De ambtenaar belast met de grensbewaking weigert toegang aan de vreemdeling op grond van artikel 3, eerste lid, onder d, Vw juncto artikel 8.8 Vb en gebruikt hiervoor model M18. De motivering in model M18 moet concreet zijn. De ambtenaar belast met de grensbewaking mag niet volstaan met de enkele mededeling dat de vreemdeling een gevaar oplevert voor de openbare orde, de nationale veiligheid of de volksgezondheid. Bij de kennisgeving van de toegangsweigering moet de ambtenaar belast met de grensbewaking vermelden dat daartegen binnen vier weken administratief beroep kan worden ingesteld bij de IND. De vreemdeling mag de behandeling van het administratief beroepschrift niet in Nederland afwachten. De vreemdeling moet Nederland op grond van artikel 5, eerste lid, Vw onmiddellijk verlaten, tenzij er sprake is van een eerste verzoek om een voorlopige voorziening. De ambtenaar belast met de grensbewaking moet een (toegangs)weigeringsstempel aanbrengen op het geldige document voor grensoverschrijding van onderdanen van de EU, de EER en Zwitserland en van hun familieleden.
4.11 Diplomatieke en consulaire koeriers
Diplomatieke en consulaire koeriers zijn:
beroepskoeriers;
als zodanig voor één reis aangewezen.
De vreemdelingen moeten in het bezit zijn van een officieel document waaruit hun bijzondere status en het aantal pakketten welke de diplomatieke of consulaire tas vormen, blijkt.
De pakketten moeten aan de buitenkant duidelijk zichtbare kentekenen hebben, waaruit hun aard blijkt. De koerier geniet persoonlijke onschendbaarheid. De ambtenaar belast met de grensbewaking mag de dwangmiddelen uit artikel 50, tweede, derde, vierde en vijfde lid, Vw niet toepassen. De ambtenaar belast met de grensbewaking mag de diplomatieke of consulaire tas niet openen of innemen.
4.12 Passagierende zeelieden
Een zeeman die wil passagieren moet een identiteitsdocument ter inzage aanbieden aan de ambtenaar belast met de grensbewaking. Een geldig document voor grensoverschrijding is in dat geval voldoende.
Het hoofd van de grensdoorlaatpost stelt een aantekening op de bemanningslijst achter de naam van de zeeman wanneer een zeeman niet of niet langer aan de in de SGC neergelegde voorwaarden voor passagieren voldoet. Het hoofd van de grensdoorlaatpost mag de zeeman bij gevaar voor de openbare orde, de nationale veiligheid of de volksgezondheid met toepassing van artikel 50 Vw overbrengen naar de vreemdelingenpolitie. Het hoofd van de grensdoorlaatpost brengt de zeeman in ieder geval in de volgende situaties daar naar toe:
de zeeman staat gesignaleerd als ongewenst vreemdeling of als ongewenst verklaarde vreemdeling op grond van artikel 67 Vw, of er is sprake van een inreisverbod;
de zeeman is achtergebleven na vertrek van het zeeschip, dan wel is afgemonsterd, zonder te voldoen aan de voorwaarden voor binnenkomst en verblijf in Nederland.
De ambtenaar belast met de grensbewaking hoeft geen machtiging te vragen voor het verlenen van een visum aan een zeeman die toegang wil tot andere plaatsen dan de gemeente, waarin de haven gelegen is waar zijn zeeschip is afgemeerd of de daaraan grenzende gemeenten.
4.13 Adoptiekind, adoptiefkind en pleegkind
Een vreemdeling die Nederland wil binnenkomen voor verblijf met als doel ‘adoptiekind’, ‘adoptiefkind’ dan wel ‘pleegkind’ moet in het bezit zijn van een geldig document voor grensoverschrijding. Dit geldig document voor grensoverschrijding is een geldig paspoort voorzien van een geldige mvv als die vereist is.
De ambtenaar belast met de grensbewaking verleent toegang aan een vreemdeling aan wie als adoptiekind, adoptiefkind dan wel als pleegkind een mvv is afgegeven. De ambtenaar belast met de grensbewaking moet de IND raadplegen als geen mvv voor verblijf als adoptiekind, adoptiefkind dan wel als pleegkind is verleend.
De IND verleent uitsluitend toestemming voor de inreis in de volgende situaties:
de vreemdeling is een adoptiekind, adoptiefkind voor wie de aspirant adoptieouders of adoptiefouders een document kunnen overleggen waaruit blijkt dat de autoriteiten van het land van herkomst instemmen met de opneming van het kind in het gezin van de aspirant adoptieouders of adoptiefouders in Nederland;
er is sprake van klemmende redenen van humanitaire aard.
In beide gevallen legt de ambtenaar belast met de grensbewaking de vreemdeling een meldplicht op als bedoeld in artikel 4.26 Vb.
De ambtenaar belast met de grensbewaking verlangt in het geval er sprake is van klemmende redenen van humanitaire aard van de aspirant pleegouders dat zij een garantverklaring (zie de bijlage 6c VV) ondertekenen. Aspirant adoptieouders of adoptiefouders hoeven geen garantverklaring te ondertekenen.
