Article 10a

By way of derogation from Article 10, paragraph 2, the rent may be increased to a maximum of:
the amount provided for that year in the step-by-step increase of the rent agreed upon at the commencement of the lease, as referred to in Article 7:252c(a) of the Dutch Civil Code (Burgerlijk Wetboek);
the amount of the rent immediately preceding the date on which the rent was not increased or, as the case may be, was reduced in accordance with Article 7:252c under b of the Dutch Civil Code (Burgerlijk Wetboek), increased by the sum of at most the increases permitted pursuant to Article 10, paragraph 2, over the years since that date.
The increase referred to under (b) shall not result in a rent higher than the amount specified in Article 13, paragraph 1, point (a), of the Rent Subsidy Act (Wet op de huurtoeslag) on the effective date of the proposed rent increase, unless the rent on the day prior to the date on which the rent was not increased or, as the case may be, was decreased, is lower than, or on the day after that date is higher than, the amount specified in that article on that day.
By way of derogation from Article 10, paragraphs 3 and 4 respectively, if the rent has not been increased or has been decreased, as the case may be, upon a written request by the tenant no earlier than three years prior to the effective date of the rent increase, the rent may be increased to no more than the amount of the rent immediately preceding the date on which the rent was not increased or was decreased, as the case may be, increased by the sum of at most the increases permitted pursuant to Article 10, paragraphs 3 and 4 respectively, for the years since that date. The increase referred to in the first sentence shall not lead to a rent higher than the amount mentioned in Article 13, paragraph 1, point a, of the Rent Subsidy Act (Wet op de huurtoeslag) on the effective date of the proposed rent increase, unless the rent on the day before the date on which the rent was not increased or was decreased, as the case may be, is lower than, or on the day after that date is higher than, the amount mentioned in that article on that day.
In afwijking van artikel 10, tweede lid, kan de huurprijs worden verhoogd tot ten hoogste:
het bedrag dat voor dat jaar is voorzien in de bij aanvang van de huur overeengekomen stapsgewijze verhoging van de huurprijs, bedoeld in artikel 7:252c onder a BW;
het bedrag van de huurprijs direct voorafgaand aan de datum waarop de huurprijs overeenkomstig artikel 7:252c onder b BW niet is verhoogd respectievelijk is verlaagd, vermeerderd met de som van ten hoogste de krachtens artikel 10, tweede lid, toegelaten verhogingen over de jaren sinds die datum.
De onder b bedoelde verhoging leidt niet tot een hogere huurprijs dan het op de ingangsdatum van de voorgestelde huurverhoging in artikel 13, eerste lid, onderdeel a, van de Wet op de huurtoeslag genoemde bedrag, tenzij de huurprijs op de dag voor de datum waarop de huurprijs niet is verhoogd respectievelijk is verlaagd, lager is dan wel op de dag na die datum hoger is dan het op die dag in dat artikel genoemde bedrag.
In afwijking van artikel 10, derde respectievelijk vierde lid, kan de huurprijs, indien niet eerder dan drie jaar voor de ingangsdatum van de huurverhoging de huurprijs op schriftelijk verzoek van de huurder niet is verhoogd respectievelijk is verlaagd, worden verhoogd tot ten hoogste het bedrag van de huurprijs direct voorafgaand aan de datum waarop de huurprijs niet is verhoogd respectievelijk is verlaagd vermeerderd met de som van ten hoogste de krachtens artikel 10, derde respectievelijk vierde lid, toegelaten verhogingen over de jaren sinds die datum. De in de eerste zin bedoelde verhoging leidt niet tot een hogere huurprijs dan het op de ingangsdatum van de voorgestelde huurverhoging in artikel 13, eerste lid, onderdeel a, van de Wet op de huurtoeslag genoemde bedrag, tenzij de huurprijs op de dag voor de datum waarop de huurprijs niet is verhoogd respectievelijk is verlaagd, lager is dan wel op de dag na die datum hoger is dan het op die dag in dat artikel genoemde bedrag.
