The court shall examine the identity of the person claimed in the manner referred to in Article 27a, first paragraph, first sentence, of the Code of Criminal Procedure, as well as the admissibility of the petition for extradition and the possibility of granting it. The court is also authorised to establish the identity of the person claimed in the manner referred to in Article 27a, second paragraph, of that Code, if there is doubt regarding their identity. Article 29c, second paragraph, of that Code shall apply mutatis mutandis.

The public prosecutor shall present his opinion at the hearing of the court regarding the admissibility of the requested extradition and shall submit a written summary thereof to the court. The person claimed and his counsel shall likewise be afforded the opportunity to make relevant observations regarding the request for extradition and the decisions to be taken in connection therewith.

If the requested person asserts that he can demonstrate without delay that he is not guilty of the facts for which his extradition is requested, the court shall examine that assertion.

If the court deems it necessary with a view to the investigation to be conducted by it pursuant to the first or third paragraph of this article, it shall order—if necessary, accompanied by an order for compulsory appearance—the summoning or written notification of witnesses or experts at a time to be determined by it.

De rechtbank onderzoekt de identiteit van de opgeëiste persoon op de wijze, bedoeld in artikel 27a, eerste lid, eerste volzin, van het Wetboek van Strafvordering, alsmede de ontvankelijkheid van het verzoek tot uitlevering en de mogelijkheid van inwilliging daarvan. De rechtbank is tevens bevoegd de identiteit van de opgeëiste persoon vast te stellen op de wijze, bedoeld in artikel 27a, tweede lid, van dat wetboek, indien over zijn identiteit twijfel bestaat. Artikel 29c, tweede lid, van dat wetboek is van overeenkomstige toepassing.

De officier van justitie geeft ter zitting van de rechtbank zijn opvatting over de toelaatbaarheid van de verzochte uitlevering en legt een schriftelijke samenvatting daaromtrent aan de rechtbank over. De opgeëiste persoon en diens raadsman worden eveneens in de gelegenheid gesteld tot het maken van terzake dienende opmerkingen omtrent het verzoek tot uitlevering en de in verband daarmede te nemen beslissingen.

Beweert de opgeëiste persoon dat hij onverwijld kan aantonen niet schuldig te zijn aan de feiten waarvoor zijn uitlevering is gevraagd, dan onderzoekt de rechtbank die bewering.

Indien de rechtbank zulks met het oog op het door haar krachtens het eerste of derde lid van dit artikel in te stellen onderzoek noodzakelijk acht, gelast zij - zo nodig onder bijvoeging van een bevel tot medebrenging - tegen een door haar te bepalen tijdstip de dagvaarding of schriftelijke oproeping van getuigen of deskundigen.
