Article 10.17

It is prohibited:
to use a radio apparatus on board a ship or aircraft outside any national territory for the purpose of broadcasting programmes;
to operate a radio apparatus intended for use as referred to in (a);
to make available or to install a radio apparatus, knowing that it is intended for a use as referred to under (a);
to make a vessel or aircraft available in the knowledge that it is intended to be used on board for the purpose of making broadcasts as referred to in (a).
It is prohibited to intentionally cooperate in the violation of any of the prohibitions referred to in the first paragraph by being helpful in doing so, or by providing the opportunity, means, or information for that purpose. Acts of cooperation shall in any event be considered to include:
the making available of material for the benefit of the ship or aircraft, or of the radio apparatus;
the maintenance or repair of the vessel or aircraft, or of the radio apparatus;
the provisioning of the vessel or aircraft;
the transport of persons or goods to or from the ship or aircraft, or the making available of means for such transport;
the production of programmes or parts thereof, intended to be broadcast;
the issuing of commissions for the broadcasting of programmes or parts thereof, or the provision of mediation in obtaining such commissions.
The second paragraph shall not apply if the acts referred to therein are performed for the purpose of assisting the vessel or aircraft in an emergency or protecting human lives.
For the purposes of this article, the term ship or aircraft shall also include any other floating or airborne object.
Het is verboden:
een radioapparaat te gebruiken om aan boord van een schip of luchtvaartuig buiten elk nationaal gebied programma's uit te zenden;
een radioapparaat, bestemd voor een gebruik als onder a bedoeld, te exploiteren;
een radioapparaat ter beschikking te stellen of aan te leggen in de wetenschap, dat het is bestemd voor een gebruik als bedoeld onder a;
een schip of luchtvaartuig ter beschikking te stellen in de wetenschap, dat dit is bestemd om aan boord daarvan uitzendingen te doen als onder a bedoeld.
Het is verboden aan overtreding van een der in het eerste lid bedoelde verboden opzettelijk mee te werken door daarbij behulpzaam te zijn dan wel daartoe gelegenheid, middelen of inlichtingen te verschaffen. Als handelingen van medewerking worden in elk geval beschouwd:
het ter beschikking stellen van materiaal ten behoeve van het schip of luchtvaartuig dan wel van het radioapparaat;
het onderhouden of herstellen van het schip of luchtvaartuig dan wel van het radioapparaat;
het bevoorraden van het schip of luchtvaartuig;
het vervoeren van personen of goederen naar of van het schip of luchtvaartuig dan wel het ter beschikking stellen van middelen tot dat vervoer;
het vervaardigen van programma's of onderdelen daarvan, bestemd om te worden uitgezonden;
het geven van opdrachten tot het uitzenden van programma's of onderdelen daarvan dan wel het verlenen van bemiddeling bij het verkrijgen van zodanige opdrachten.
Het tweede lid blijft buiten toepassing, indien de aldaar bedoelde handelingen worden verricht teneinde in geval van nood het schip of luchtvaartuig bij te staan of mensenlevens te beschermen.
Onder schip of luchtvaartuig wordt in dit artikel mede begrepen elk ander drijvend of door de lucht gedragen voorwerp.
