Article 102d

As from the date of entry into force of this article or, if that is later, from the date of the granting of the patent, patents granted pursuant to the Kingdom Patents Act (Rijksoctrooiwet) or granted pursuant to Articles 102a, 102b or 102c shall have the same legal consequences in the Netherlands, Curaçao and Sint Maarten as patents granted pursuant to Article 36, and the provisions of this Kingdom Act shall apply thereto, provided that:
the application of Article 76 is limited to patents granted pursuant to Article 102a or Article 102c, paragraph 1, and
the application of Articles 84 up to and including 86 is limited to patents granted pursuant to Articles 102a, 102b or 102c.
As from the date of entry into force of this article or, if that is later, from the date of the granting of the patent, patents granted pursuant to the Kingdom Patents Act (Rijksoctrooiwet) or granted pursuant to Articles 102a, 102b or 102c shall have the same legal consequences in Aruba as patents granted pursuant to Article 34 of the National Ordinance of Aruba of 5 May 1997 laying down rules with regard to patents (Patent Ordinance).
Vanaf de datum van inwerkingtreding van dit artikel of, indien dat later is, vanaf de datum van verlening van het octrooi, hebben octrooien die zijn verleend op grond van de Rijksoctrooiwet of die worden verleend op grond van de artikelen 102a, 102b of 102c, in Nederland Curaçao en Sint Maarten dezelfde rechtsgevolgen als octrooien die zijn verleend op grond van artikel 36 en zijn daarop de bepalingen van deze rijkswet van toepassing, met dien verstande dat:
de toepassing van artikel 76 beperkt is tot octrooien die zijn verleend op grond van artikel 102a of 102c, eerste lid, en
de toepassing van de artikelen 84 tot en met 86 beperkt is tot octrooien die zijn verleend op grond van de artikelen 102a, 102b of 102c.
Vanaf de datum van inwerkingtreding van dit artikel of, indien dat later is, vanaf de datum van verlening van het octrooi, hebben octrooien die zijn verleend op grond van de Rijksoctrooiwet of die worden verleend op grond van de artikelen 102a, 102b of 102c, in Aruba dezelfde rechtsgevolgen als octrooien die zijn verleend op grond van artikel 34 van de Landsverordening van Aruba van 5 mei 1997 houdende regels met betrekking tot octrooien (Octrooiverordening).
