Article 23 of the Kingdom Patents Act 1995 (Rijksoctrooiwet 1995) applies to a petition for restoration to the former state that is submitted after the entry into force of this article.
The Office shall grant a patent on a patent application that is restored to its former state after the entry into force of this Act, by placing a dated entry on the application in the form as submitted by the applicant or as subsequently amended by him.
The patent shall take effect as of the date on which the decision for restoration becomes irrevocable.
Op een verzoek tot herstel in de vorige toestand dat is ingediend na de inwerkingtreding van dit artikel, is artikel 23 van de Rijksoctrooiwet 1995 van toepassing.
Het bureau verleent op een octrooiaanvrage die na de inwerkingtreding van deze wet wordt hersteld in de vorige toestand, octrooi door het plaatsen van een gedateerde aantekening op de aanvrage in de vorm zoals deze door de aanvrager is ingediend of door hem nadien is gewijzigd.
Het octrooi begint te werken met ingang van de datum waarop het besluit tot herstel onherroepelijk is.
