Subject to the provisions of this Kingdom Act, European patents shall, from the day on which the mention of the grant is published in accordance with Article 97(3) of the European Patent Convention, have the same legal effects and be subject to the same law as patents granted in accordance with Article 36 of this Kingdom Act.
A European patent shall, subject to earlier lapse or revocation by the court, remain in force until the expiry of a term of twenty years, calculated from the date of filing which the European patent application that led to the European patent concerned possesses pursuant to Article 80 of the European Patent Convention, with due observance of Articles 61 or 76 of that Convention.
For the application of Articles 55, paragraph 1, 57, paragraph 4, and 77, paragraph 1, to European patents, the date of filing shall be: the date of filing which the European patent application, which has led to the European patent concerned, possesses pursuant to Article 80 of the European Patent Convention, with due observance of Articles 61 or 76 of that Convention.
Met inachtneming van het in deze rijkswet bepaalde hebben Europese octrooien vanaf de dag, waarop overeenkomstig artikel 97, derde lid, van het Europees Octrooiverdrag de vermelding van de verlening is gepubliceerd, dezelfde rechtsgevolgen en zijn zij aan hetzelfde recht onderworpen als de overeenkomstig artikel 36 van deze rijkswet verleende octrooien.
Een Europees octrooi blijft, behoudens eerder verval of vernietiging door de rechter, van kracht tot het verstrijken van een termijn van twintig jaren, te rekenen vanaf de datum van indiening, die de Europese octrooiaanvrage, die tot het betrokken Europees octrooi heeft geleid, ingevolge artikel 80 van het Europees Octrooiverdrag met inachtneming van de artikelen 61 of 76 van dat verdrag bezit.
Voor de toepassing van de artikelen 55, eerste lid, 57, vierde lid, en 77, eerste lid, op Europese octrooien geldt als dag van indiening: de datum van indiening die de Europese octrooiaanvrage, die tot het betrokken Europees octrooi heeft geleid, ingevolge artikel 80 van het Europees Octrooiverdrag met inachtneming van de artikelen 61 of 76 van dat verdrag bezit.
