Within eight months after the filing of a patent application as referred to in Article 40, Our Minister of Defence shall decide whether the content of the application must remain secret in the interest of the defence of the Kingdom or its allies. He shall notify the office of his decision.

2.

A decision that the contents of the application must remain secret has the effect that the registration of the application in the patent register remains suspended until three years after the publication of the decision.

3.

The suspension shall end if:

a.

Our aforementioned Minister shall decide that the application need not remain confidential;

b.

a decision has not been forthcoming within the period referred to in the first paragraph.

Our aforementioned Minister may, at any time within six months prior to the expiration of the suspension period, extend this period by three years. He shall notify the office of his decision.

Our aforementioned Minister may at any time decide that the content of the application no longer needs to remain secret. The consequence of this decision is that the suspension shall terminate.

The office shall notify the applicant without delay of a decision pursuant to the first, third, fourth or fifth paragraph. It shall likewise notify the applicant without delay if a decision has not been forthcoming as referred to in the third or fifth paragraph.

As long as the suspension has not ended, the office shall, at the request of Our aforementioned Minister, send to the latter a copy of all documents exchanged between the office and the applicant in this regard.

8.

If the suspension ends, the registration of the application in the patent register shall nevertheless take place, unless, at the request of the applicant, not before three months have elapsed.

Binnen acht maanden na indiening van een octrooiaanvrage als bedoeld in artikel 40 besluit Onze Minister van Defensie of de inhoud van de aanvrage in het belang van de verdediging van het Koninkrijk of zijn bondgenoten geheim moet blijven. Hij maakt zijn besluit aan het bureau bekend.

Een besluit dat de inhoud van de aanvrage geheim moet blijven heeft tot gevolg dat de inschrijving in het octrooiregister van de aanvrage blijft opgeschort tot drie jaren na de bekendmaking van het besluit.

De opschorting eindigt indien:

a.

Onze genoemde minister besluit, dat de aanvrage niet geheim behoeft te blijven;

b.

een besluit binnen de in het eerste lid genoemde termijn is uitgebleven.

Onze genoemde minister kan telkens binnen zes maanden voor het verstrijken van de termijn van opschorting deze termijn met drie jaren verlengen. Hij maakt zijn besluit aan het bureau bekend.

Onze genoemde minister kan te allen tijde besluiten dat de inhoud van de aanvrage niet langer geheim behoeft te blijven. Het besluit heeft tot gevolg dat de opschorting eindigt.

6.

Van een besluit krachtens het eerste, derde, vierde of vijfde lid, doet het bureau onverwijld mededeling aan de aanvrager. Het deelt deze eveneens onverwijld mede indien een besluit is uitgebleven zoals bedoeld in het derde of vijfde lid.

7.

Zolang de opschorting niet is geëindigd, zendt het bureau op verzoek van Onze genoemde minister aan deze afschrift van alle ter zake tussen het bureau en de aanvrager gewisselde stukken.

8.

Indien de opschorting eindigt, geschiedt niettemin de inschrijving van de aanvrage in het octrooiregister, tenzij op verzoek van de aanvrager, niet voordat drie maanden zijn verstreken.
