Processing of patent applications

If the Office is of the opinion that maintaining the secrecy of the contents of a patent application may be in the interest of the defence of the Kingdom or its allies, it shall make this known as soon as possible, but no later than three months after the filing of the application. Our Minister of Defence may issue instructions to the Office regarding the assessment of the question of whether such an interest may exist.

Simultaneously with the publication as referred to in the first paragraph, the office shall send a copy of the decision and of the description and drawings belonging to the application to Our aforementioned Minister.

In the event that the first paragraph applies, the registration of the application in the patent register shall be suspended.

Indien het bureau van oordeel is, dat het geheim blijven van de inhoud van een octrooiaanvrage in het belang van de verdediging van het Koninkrijk of zijn bondgenoten kan zijn, maakt het dit zo spoedig mogelijk, doch uiterlijk binnen drie maanden na de indiening van de aanvrage bekend. Onze Minister van Defensie kan ten aanzien van de beoordeling van de vraag, of zodanig belang aanwezig kan zijn, aanwijzingen geven aan het bureau.

Tegelijk met de bekendmaking als bedoeld in het eerste lid zendt het bureau afschrift van het besluit en van de tot de aanvrage behorende beschrijving en tekeningen aan Onze genoemde minister.

3.

Ingeval het eerste lid toepassing vindt, wordt de inschrijving in het octrooiregister van de aanvrage opgeschort.
