If an incident occurs during the leave, the director may, depending on the nature of the incident and the leave, take measures. An incident shall in any event be deemed to have occurred when the juvenile:
is involved in a disturbance of public order or the commission of a criminal offence during the leave;
culpably returns late or fails to return to the institution;
returns to the institution under the influence of alcohol or narcotic substances;
carries contraband upon returning to the institution.
Without prejudice to the director's obligation to report the incident elsewhere, data concerning incidents during leave shall be included in the file.
Indien zich tijdens het verlof een incident voordoet, kan de directeur, afhankelijk van de aard van het incident en het verlof, maatregelen nemen. Van een incident is in ieder geval sprake wanneer de jeugdige:
tijdens het verlof betrokken is bij een verstoring van de openbare orde of het plegen van een strafbaar feit;
verwijtbaar te laat of niet in de inrichting terugkeert;
onder invloed van alcohol of verdovende middelen in de inrichting terugkeert;
bij terugkeer in de inrichting contrabande met zich meevoert.
Onverminderd de verplichting van de directeur om het incident elders te signaleren, worden gegevens over incidenten tijdens het verlof opgenomen in het dossier.
