Persons who, with due observance of Article 96, paragraph 1, are employed for the benefit of the Police Academy, shall be equated with police officers as referred to in Article 2, under a, b, or c, insofar as they were, immediately prior thereto, police officers as referred to in Article 2, under a, b, or c, respectively. The first sentence shall apply mutatis mutandis to persons who, with due observance of Article 83, paragraph 1, are employed for the benefit of the Police Education Council.
By way of derogation from Article 16 of the Framework Act on Independent Administrative Bodies (Kaderwet zelfstandige bestuursorganen), Articles 11 and 12 shall apply to the persons referred to in the first paragraph who have been appointed for the performance of police duties, insofar as they act for the maintenance of public order or for the performance of assistance duties, or for the criminal law enforcement of the legal order, or perform duties in the service of the judiciary.
De personen die met inachtneming van artikel 96, eerste lid, werkzaam zijn ten behoeve van de Politieacademie, worden gelijkgesteld met ambtenaren van politie als bedoeld in artikel 2, onder a, b, of c, voor zover zij direct daaraan voorafgaand ambtenaren van politie als bedoeld in artikel 2, onder a, b onderscheidenlijk c, waren. De eerste volzin is van overeenkomstige toepassing op de personen die met inachtneming van artikel 83, eerste lid, werkzaam zijn ten behoeve van de politieonderwijsraad.
In afwijking van artikel 16 van de Kaderwet zelfstandige bestuursorganen zijn de artikelen 11 en 12 op de personen, bedoeld in het eerste lid, die zijn aangesteld voor de uitvoering van de politietaak, van toepassing, voor zover zij optreden ter handhaving van de openbare orde of ter uitvoering van de hulpverleningstaak onderscheidenlijk ter strafrechtelijke handhaving van de rechtsorde, dan wel taken verricht ten dienste van de justitie.
