The supervisory authority shall, within three months after receipt of the data referred to in Article 194, paragraph 2, communicate these data to the competent authorities of the Member State whose social and labour legislation applicable to occupational pension provision applies to the legal relationship between the contributing undertaking and the employees, unless the pension fund does not possess the authorisation referred to in Article 125, or the supervisory authority has reason to doubt that the administrative structure or the financial position of the pension fund, or the expertise and reliability of the persons managing the fund, are compatible with the proposed activities in that Member State.
The supervisor shall simultaneously notify the fund of the provision of the data to the competent authorities referred to in the first paragraph.
The supervisor shall notify the fund of information regarding the applicable provisions of social and labour legislation, received from the competent authorities referred to in the first paragraph.
De toezichthouder doet binnen drie maanden na ontvangst van de gegevens, bedoeld in artikel 194, tweede lid, mededeling van deze gegevens aan de bevoegde autoriteiten van de lidstaat waarvan de voor bedrijfspensioenvoorziening geldende sociale en arbeidswetgeving van toepassing is op de rechtsverhouding tussen de bijdragende onderneming en de werknemers, tenzij het pensioenfonds niet beschikt over de vergunning, bedoeld in artikel 125, of de toezichthouder reden heeft te betwijfelen dat de administratieve structuur of de financiële positie van het pensioenfonds, of de deskundigheid en betrouwbaarheid van de personen die het fonds besturen met de in die lidstaat voorgenomen activiteiten verenigbaar zijn.
De toezichthouder doet gelijktijdig mededeling aan het fonds van de verstrekking van de gegevens aan de bevoegde autoriteiten, bedoeld in het eerste lid.
De toezichthouder doet mededeling aan het fonds van informatie over de toepasselijke bepalingen van sociale en arbeidswetgeving, ontvangen van de bevoegde autoriteiten, bedoeld in het eerste lid.
