A pension fund shall notify the supervisory authority of an intention to receive contributions from a contributing undertaking with its registered office in a Member State other than the Netherlands.
The notification referred to in paragraph 1 shall be accompanied by a statement of:
the Member State whose social and labour law relevant to the field of occupational pension schemes is applicable to the relationship between the contributing undertaking and the employees or the self-employed person, as specified by the contributing undertaking where applicable;
the name of the contributing enterprise and the place where the contributing enterprise has its central management; and
the principal characteristics of the pension scheme that will be implemented for that enterprise.
Een pensioenfonds stelt de toezichthouder in kennis van een voornemen bijdragen te gaan ontvangen van een bijdragende onderneming met zetel in een andere lidstaat dan Nederland.
De kennisgeving, bedoeld in het eerste lid, gaat vergezeld van een opgave van:
de lidstaat waarvan de voor bedrijfspensioenvoorziening geldende sociale en arbeidswetgeving van toepassing is op de rechtsverhouding tussen de bijdragende onderneming en de werknemers of op de zelfstandige, die in voorkomend geval wordt opgegeven door de bijdragende onderneming;
de naam van de bijdragende onderneming en de plaats waar de bijdragende onderneming haar hoofdbestuur heeft; en
de voornaamste kenmerken van de pensioenregeling die voor die onderneming zal worden uitgevoerd.
