The pension provider that is prepared to act as the receiving pension provider shall inform the person who wishes to apply the capital arising from a flexible contribution agreement or a contribution-benefit agreement on the pension date for a variable benefit about the consequences and risks relevant to him in the case of a variable benefit, including a statement of the amount of the variable benefits and a statement of the amount of the fixed benefits if the capital were to be applied for that purpose. These statements shall, insofar as they concern old-age pension, also be presented on the basis of a pessimistic scenario, an expected scenario, and an optimistic scenario. The pension provider that offers a spreading period of longer than five years shall explicitly inform the participant about the consequences and risks relevant to him thereof.
By or pursuant to an Order in Council (algemene maatregel van bestuur), further rules shall be established with respect to this Article concerning, inter alia, the information to be provided, the calculation rules, and the manner in which the information is provided.
De pensioenuitvoerder die bereid is op te treden als ontvangende pensioenuitvoerder informeert degene die het uit een flexibele premieovereenkomst of premie-uitkeringsovereenkomst voortvloeiende kapitaal op de pensioendatum wenst aan te wenden voor een variabele uitkering over de voor hem relevante gevolgen en risico’s bij een variabele uitkering waaronder een opgave van de hoogte van de variabele uitkeringen en een opgave van de hoogte van de vastgestelde uitkeringen indien het kapitaal daarvoor zou worden aangewend. Deze opgaven worden, voor zover het ouderdomspensioen betreft, tevens weergegeven op basis van een pessimistisch scenario, een verwacht scenario en een optimistisch scenario. De pensioenuitvoerder die een spreidingsperiode van langer dan vijf jaar aanbiedt, informeert de deelnemer expliciet over de voor hem relevante gevolgen en risico’s daarvan.
Bij of krachtens algemene maatregel van bestuur worden nadere regels gesteld met betrekking tot dit artikel over onder meer de te verstrekken informatie, de rekenregels en de wijze waarop de informatie wordt verstrekt.
