The placement of a person sentenced to a custodial sentence in an institution for the nursing of persons placed at the disposal of the government (ter beschikking gestelden) shall take place before six months have elapsed since the decision referred to in Article 6:2:8, paragraph 1, of the Code of Criminal Procedure was taken, having been spent in a prison or house of detention.
If Our Minister, taking into account the requirements referred to in Article 6.2, paragraph 2, of the Forensic Care Act (Wet forensische zorg), is of the opinion that the placement is not possible within the period stipulated in the first paragraph, he may extend this period by three months at a time.
The person sentenced to a custodial sentence may lodge an appeal with the Council against the decision to extend, as referred to in the second paragraph. The provisions of Chapter XVI of the Principles of Prison Regime and Care of Detainees Act (Beginselenwet verpleging ter beschikking gestelden) shall apply mutatis mutandis.
De plaatsing van een tot vrijheidsstraf veroordeelde in een instelling voor verpleging van ter beschikking gestelden geschiedt voordat zes maanden sedert de beslissing, bedoeld in artikel 6:2:8, eerste lid, van het Wetboek van Strafvordering is genomen, in een gevangenis of huis van bewaring zijn doorgebracht.
Indien Onze Minister, rekening houdende met de in artikel 6.2, tweede lid, van de Wet forensische zorg genoemde eisen, van oordeel is dat de plaatsing niet binnen de in het eerste lid gestelde termijn mogelijk is, kan hij deze termijn telkens met drie maanden verlengen.
Tegen de beslissing tot verlenging, bedoeld in het tweede lid, kan de tot vrijheidsstraf veroordeelde beroep instellen bij de Raad. Het bepaalde in Hoofdstuk XVI van de Beginselenwet verpleging ter beschikking gestelden is van overeenkomstige toepassing.
