Appeal against medical conduct

The appeals committee and the secretary are authorised to inspect the medical file of the detainee for the purpose of handling the appeal petition.

The hearing of the appeal shall not take place in public, unless the appeals committee is of the opinion that a non-public hearing is incompatible with any provision of a treaty applicable in the Netherlands that is binding on all persons.

The secretary of the appeals committee shall send a copy of the notice of appeal to the institution's physician and shall request the report of the mediation from the Medical Advisor.

The appeals committee shall provide the detainee and the institutional physician the opportunity to submit comments regarding the appeal, either orally or in writing, unless it deems the appeal to be manifestly inadmissible, manifestly unfounded, or manifestly well-founded immediately. The appeals committee may determine that the oral comments may be made before a member of the committee as referred to in Article 71d, paragraph 1.

Article 64, paragraphs 2 and 3, shall apply mutatis mutandis.

Article 64, paragraph 4, shall apply mutatis mutandis. The appeals committee may determine that, in the event that oral information is obtained from another person, the parties involved shall be given the opportunity exclusively to submit in writing the questions they wish to see put to that person.

Article 65, paragraphs 1 up to and including 3, shall apply mutatis mutandis.

De beroepscommissie en de secretaris zijn ten behoeve van de behandeling van het beroepschrift bevoegd het medisch dossier van de gedetineerde in te zien.

De behandeling van het beroepschrift vindt niet in het openbaar plaats, behoudens ingeval de beroepscommissie van oordeel is dat de niet openbare behandeling niet verenigbaar is met enige een ieder verbindende bepaling van een in Nederland geldend verdrag.

De secretaris van de beroepscommissie zendt de inrichtingsarts een afschrift van het beroepschrift toe en vraagt het verslag van de bemiddeling op bij de Medisch Adviseur.

De beroepscommissie stelt de gedetineerde en de inrichtingsarts in de gelegenheid omtrent het beroepschrift mondeling of schriftelijk opmerkingen te maken, tenzij zij het beroep aanstonds kennelijk niet-ontvankelijk, kennelijk ongegrond of kennelijk gegrond acht. De beroepscommissie kan bepalen dat de mondelinge opmerkingen ten overstaan van een lid van de commissie, bedoeld in artikel 71d, eerste lid, kunnen worden gemaakt.

Artikel 64, tweede en derde lid, is van overeenkomstige toepassing.

Artikel 64, vierde lid, is van overeenkomstige toepassing. De beroepscommissie kan bepalen dat ingeval bij een andere persoon mondeling inlichtingen worden ingewonnen, de betrokkenen uitsluitend in de gelegenheid worden gesteld schriftelijk de vragen op te geven die zij aan die persoon gesteld wensen te zien.

Artikel 65, eerste tot en met derde lid, is van overeenkomstige toepassing.
