Article 36, paragraphs 3 and 4, shall not apply to letters addressed by the detainee to, or originating from:
members of the Royal House;
the House of Representatives or the Senate of the States General, members thereof, the Dutch members of the European Parliament, or a committee from either of the two chambers;
Our Minister;
judicial authorities;
the National Ombudsman;
the inspectors of the Health and Youth Care Inspectorate;
the Council, a committee thereof, or members or extraordinary members thereof;
the supervisory committee or a complaints committee, or members thereof;
bodies, or members thereof, which pursuant to a statutory provision or a treaty applicable in the Netherlands:
to have jurisdiction to hear complaints or to deal with matters initiated by a complaint; or
are charged with the supervision of the treatment of persons who have been deprived of their liberty;
their legal counsel;
their probation officer;
other persons or bodies to be designated by Our Minister or the director.
Our Minister may lay down further rules regarding the manner of dispatching letters to and by the persons and bodies referred to in the first paragraph.
Artikel 36, derde en vierde lid, is niet van toepassing op brieven, door de gedetineerde gericht aan of afkomstig van:
leden van het Koninklijk Huis;
de Eerste of Tweede Kamer der Staten-Generaal, leden daarvan, de Nederlandse leden van het Europese Parlement of een commissie uit een van beide parlementen;
Onze Minister;
justitiële autoriteiten;
de Nationale ombudsman;
de inspecteurs van de Inspectie gezondheidszorg en jeugd;
de Raad, een commissie daaruit of leden of buitengewone leden daarvan;
de commissie van toezicht of een beklagcommissie, of leden daarvan;
organen, of leden daarvan, die krachtens een wettelijk voorschrift of een in Nederland geldend verdrag:
bevoegd zijn tot kennisneming van klachten of behandeling van met een klacht aangevangen zaken; dan wel
zijn belast met het houden van toezicht op de behandeling van personen aan wie hun vrijheid is ontnomen;
diens rechtsbijstandverlener;
diens reclasseringswerker;
andere door Onze Minister of de directeur aan te wijzen personen of instanties.
Onze Minister kan nadere regels stellen omtrent de wijze van verzending van brieven aan en door de in het eerste lid genoemde personen en instanties.
