Surrender Act (European Arrest Warrant) · Chapter V · In force since 2006-02-01

1.

In the relationship with the Member States of the European Union, this Act shall replace the Extradition Act, with the exception of Articles 50a and 51 of that Act, and the treaties concerning extradition applicable in the relationship between the Netherlands and the Member States of the European Union, namely:

a.

the European Convention on Extradition concluded in Paris on 13 December 1957 (Trb. 1965, 9), the Additional Protocol to this Convention concluded in Strasbourg on 15 October 1975 (Trb. 1979, 119), the Second Additional Protocol to this Convention concluded in Strasbourg on 17 March 1978 (Trb. 1979, 120) and, insofar as it relates to extradition, the European Convention on the Suppression of Terrorism concluded in Strasbourg on 27 January 1977 (Trb. 1985, 66);

b.

the Agreement between the Kingdom of the Netherlands and the Federal Republic of Germany on the supplementation and facilitation of the application of the European Convention on Extradition of 13 December 1957, concluded at Wittem on 30 August 1979 (Trb. 1979, no. 142);

c.

Section I and, insofar as applicable, Section III of the Treaty on Extradition and Mutual Assistance in Criminal Matters between the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands, concluded in Brussels on 27 June 1962, as amended by the protocol concluded in Brussels on 11 May 1974 (Trb. 1962, 97, and 1974, 11);

d.

Chapter III, Section 4, of the Schengen Implementation Agreement;

e.

the Convention between the Member States of the European Communities on the simplification and modernisation of methods of transmitting extradition requests of 26 May 1989 (Trb. 1990, 97);

f.

the Convention drawn up on the basis of Article K.3 of the Treaty on European Union, on simplified extradition procedure between the Member States of the European Union, concluded at Brussels on 10 March 1995 (Trb. 1995, 10);

g.

the Convention drawn up on the basis of Article K.3 of the Treaty on European Union, relating to extradition between the Member States of the European Union, concluded at Dublin on 27 September 1996 (Trb. 1996, 304).

The first paragraph shall not apply in relation to another Member State of the European Union insofar as and for as long as that Member State has not taken the measures necessary to comply with the Council Framework Decision of 13 June 2003 on the European arrest warrant and the surrender procedures between Member States of the European Union (OJ EC L 190).

Insofar as the Council of the European Union adopts a decision that deviates from the first or second paragraph, such decision may be implemented by Order in Council.

The Extradition Act shall remain applicable to the handling of a petition for extradition and to the decisions to be taken in connection therewith, in cases in which the documents concerning that petition have been received by Our Minister before the time of the entry into force of this Act.

A requested person who, at the time of the entry into force of this Act, is detained pursuant to an order issued under Article 14, 13a or 15 of the Extradition Act (Uitleveringswet), shall, if the European arrest warrant has not yet been received, be considered and treated as a person who is held in custody or remanded in custody under Article 16, 17 or 18 of this Act.

Deze wet treedt in de relatie met de lidstaten van de Europese Unie in de plaats van de Uitleveringswet, met uitzondering van de artikelen 50a en 51 van die wet, en van de in de relatie tussen Nederland en de lidstaten van de Europese Unie geldende verdragen inzake de uitlevering, te weten:

a.

het op 13 december 1957 te Parijs tot stand gekomen Europees Verdrag betreffende uitlevering (Trb. 1965, 9), het op 15 oktober 1975 te Straatsburg tot stand gekomen Aanvullend Protocol bij dit Verdrag (Trb. 1979, 119), het op 17 maart 1978 te Straatsburg tot stand gekomen Tweede Aanvullend Protocol bij dit Verdrag (Trb. 1979, 120) en, voor zover het op uitlevering betrekking heeft, het op 27 januari 1977 te Straatsburg tot stand gekomen Europees Verdrag tot bestrijding van terrorisme (Trb. 1985, 66);

b.

de op 30 augustus 1979 te Wittem tot stand gekomen Overeenkomst tussen het koninkrijk der Nederlanden en de Bondsrepubliek Duitsland betreffende de aanvulling en het vergemakkelijken van de toepassing van het Europees Verdrag betreffende de uitlevering van 13 december 1957 (Trb. 1979, nr. 142);

c.

afdeling I en voor zover van toepassing afdeling III van het op 27 juni 1962 te Brussel tot stand gekomen Verdrag aangaande de uitlevering en de rechtshulp in strafzaken tussen het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden, zoals gewijzigd bij het op 11 mei 1974 te Brussel tot stand gekomen protocol (Trb. 1962, 97, en 1974, 11);

d.

hoofdstuk III, afdeling 4, van de Uitvoeringsovereenkomst van Schengen;

e.

de Overeenkomst tussen de lidstaten van de Europese Gemeenschappen betreffende de vereenvoudiging en de modernisering van de wijze van toezending van uitleveringsverzoeken van 26 mei 1989 (Trb. 1990, 97);

f.

de op 10 maart 1995 te Brussel tot stand gekomen Overeenkomst opgesteld op grond van artikel K.3 van het Verdrag betreffende de Europese Unie aangaande de verkorte procedure tot uitlevering tussen de Lid-Staten van de Europese Unie (Trb. 1995, 10);

g.

de op 27 september 1996 te Dublin tot stand gekomen Overeenkomst opgesteld op grond van artikel K.3 van het Verdrag betreffende de Europese Unie betreffende uitlevering tussen de lidstaten van de Europese Unie (Trb. 1996, 304).

Het eerste lid blijft buiten toepassing in relatie tot een andere lidstaat van de Europese Unie voorzover en voorzolang die lidstaat niet de maatregelen heeft getroffen die noodzakelijk zijn om aan het op 13 juni 2003 te Brussel totstandgekomen kaderbesluit van de Raad betreffende het Europees aanhoudingsbevel en de procedures van overlevering tussen de lidstaten van de Europese Unie (PbEG L 190) te voldoen.

Voor zover de Raad van de Europese Unie een besluit neemt dat afwijkt van het eerste of tweede lid, kan daaraan bij algemene maatregel van bestuur uitvoering worden gegeven.

De Uitleveringswet blijft van toepassing op de behandeling van een verzoek tot uitlevering en op de in verband daarmede te nemen beslissingen, in gevallen waarin de stukken betreffende dat verzoek vóór het tijdstip van het in werking treden van deze wet zijn ontvangen door Onze Minister.

5.

Een opgeëiste persoon die op het tijdstip van het in werking treden van deze wet is gedetineerd ingevolge een bevel gegeven krachtens artikel 14, 13a of 15 van de Uitleveringswet, wordt, zo het Europees aanhoudingsbevel nog niet is ontvangen, beschouwd en behandeld als een persoon die krachtens artikel 16, 17 of 18 van deze wet in bewaring wordt gehouden of in verzekering is gesteld.
