In the cases referred to in Article 57, under (b), the examining magistrate who has issued the European arrest warrant shall, in consultation with the executing judicial authority, determine the duration of the temporary transfer and the conditions under which the temporary transfer takes place.
During his stay in this country, the person temporarily placed at disposal shall be taken into police custody by order of the public prosecutor. Articles 61 and 64, paragraph 1, shall apply accordingly, insofar as necessary.
Upon the actual surrender, the custody of the person placed at disposal is entrusted to Dutch officials who are authorised to take all appropriate measures for the security of the person placed at disposal and for the prevention of his escape.
In de gevallen bedoeld in artikel 57, onder b, bepaalt de rechter-commissaris die het Europees aanhoudingsbevel heeft uitgevaardigd in overleg met de uitvoerende justitiële autoriteit de duur van de terbeschikkingstelling en de voorwaarden waaronder de terbeschikkingstelling plaatsvindt.
Gedurende zijn verblijf hier te lande wordt de tijdelijk ter beschikking gestelde persoon op bevel van de officier van justitie in verzekering gesteld. De artikelen 61 en 64, eerste lid, zijn, voor zoveel nodig, van overeenkomstige toepassing.
Bij de feitelijke overlevering is de bewaking van de ter beschikking gestelde persoon opgedragen aan Nederlandse ambtenaren die bevoegd zijn alle dienstige maatregelen te nemen ter beveiliging van de ter beschikking gestelde persoon en ter voorkoming van zijn ontvluchting.
