Objects found in the possession of the person claimed may be seized at the request of the issuing judicial authority. The seizure may be ordered by any public prosecutor or assistant public prosecutor.
If the seizure has not taken place in the district of Amsterdam, the public prosecutor at the district public prosecutor's office of Amsterdam shall be notified thereof, and the objects shall be transferred to him upon the surrender of the requested person or, if that is impossible, as soon as possible thereafter.
In the claim referred to in Article 23, paragraph 2, the public prosecutor shall submit a list of the seized objects to the court.
In the event of surrender in accordance with § E of Section 2 of Chapter II, the public prosecutor shall, in a timely manner prior to the decision of the court referred to in Article 50, paragraph 3, in conjunction with Article 40, paragraph 1, submit a list of the seized objects to the court.
Voorwerpen, aangetroffen in het bezit van de opgeëiste persoon, kunnen op verzoek van de uitvaardigende justitiële autoriteit in beslag worden genomen. De inbeslagneming kan door elke officier of hulpofficier van justitie worden gelast.
Indien de inbeslagneming niet in het arrondissement Amsterdam heeft plaatsgevonden, wordt de officier van justitie bij het arrondissementsparket Amsterdam daarvan in kennis gesteld en worden voorwerpen bij de overdracht van de opgeëiste persoon of, indien dat onmogelijk is, zo spoedig mogelijk daarna aan hem overgedragen.
Bij de in artikel 23, tweede lid, bedoelde vordering legt de officier van justitie een lijst van de in beslag genomen voorwerpen aan de rechtbank over.
In geval van overlevering overeenkomstig § E van afdeling 2 van hoofdstuk II, legt de officier van justitie tijdig voorafgaand aan de beslissing van de rechtbank, genoemd in artikel 50, derde lid, in samenhang met artikel 40, eerste lid, een lijst van de in beslag genomen voorwerpen aan de rechtbank over.
